PRACTICE DIRECTION 5.9

PLEADINGS FOR USE AT TRIAL IN THE
DISTRICT COURT

 

1. Unnecessary material has been included in the bundle of pleadings provided for the use of the trial judge.

2. Solicitors should include only those pleadings which are relevant to the trial, e.g. the amended particulars of claim, amended defence and amended reply. The pleadings preceding these documents should not be included.

3. Where both parties are represented, it is undesirable for each firm of solicitors to submit its own bundle of documents. To do so is an unnecessary expense to the parties and of no assistance to the trial judge.

4. Where both parties are represented, an agreed paginated bundle, containing one copy of each of the documents, must be supplied to the trial judge at least two days prior to the commencement of a case set down in the Fixture List or at the commencement of a case set down in the Running List.
