CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - CHAPTER 316M CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - LONG TITLE Empowering section VerDate:30/06/1997 (Cap 316 section 11) [25 February 1994] (L.N. 116 of 1994) CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SECT 1 Interpretation VerDate:01/07/1997 Adaptation amendments retroactively made - see 23 of 1998 s. 2 In this Order, unless the context otherwise requires- "business establishment" (商業機構) means an establishment engaged in activity in the service industries; "business receipts" (業務收入) includes the value of all sales of goods, receipts from customers for services rendered to them and income from other sources; "business services" (商用服務) includes accounting and auditing, advertising, business management and consultancy services, data processing and tabulating, designing, employment agency, equipment leasing, legal services, machinery rental, market research, news agency, public relations, secretarial services, security and detective services, real estate services and engineering and technical services; (L.N. 75 of 1997) "communication" (通訊) includes postal, telephone, telegraph, radio and cable communications, message delivery and message exchange services; "community, social and personal services" (社區、社會及個人服務) includes motion picture and other entertainment services, miscellaneous amusement and recreational services, and miscellaneous personal services; (L.N. 75 of 1997) "financing" (財務) includes the business of all finance, loans, mortgage and discount companies, dealers or brokers and exchanges in stocks and shares, commodity futures, gold bullion and foreign currency, and pawnshops and money changers, but does not include banks, deposit-taking companies, restricted licence banks and representative offices of foreign banks within the meaning of the Census and Statistics (Annual Survey of Banks, Deposit-taking Companies, Restricted Licence Banks and Representative Offices of Foreign Banks) Order (Cap 316 sub. leg.) and holding companies; (23 of 1998 s. 2) "hotel" (酒店) includes any place where lodging is provided on a fee-paying basis; "import and export" (進口及出口) includes the business of importing goods for wholesaling, exporting goods, and acting as a buying agency or commission agency through arrangement for importing and exporting goods; "insurance" (保險) includes the business of insurers, reinsurers, agents and brokers of all kinds of insurance and related insurance services; "service industries" (服務行業) means any of the following industries- (a) wholesale; (b) import and export; (c) hotel; (d) transport; (e) storage and warehousing; (f) communication; (g) financing; (h) insurance; (i) business services; (j) community, social and personal services; (L.N. 75 of 1997) "storage and warehousing" (倉庫及貨倉) includes storage and warehousing facilities for hire by the general public; "survey" (調查) means the statistical survey referred to in section 2; "survey period" (調查期) means the survey period specified in or under section 5; "transport" (運輸) includes the business of providing transport services by land, water or air, renting of transport equipment, acting as an agency, management company, or branch or representative office of an establishment engaged in the provision of transport services by land, water or air, and providing supporting services or services allied to transport by land, water or air; "wholesale" (批發) includes the business of reselling new and used goods to retailers, to industrial, commercial, institutional or professional users, or to other wholesalers. (Enacted 1994) "business establishment" (商業機構) "business receipts" (業務收入) "business services" (商用服務) "communication" (通訊) "community, social and personal services" (社區、社會及個人服務) "financing" (財務) "hotel" (酒店) "import and export" (進口及出口) "insurance" (保險) "service industries" (服務行業) "storage and warehousing" (倉庫及貨倉) "survey" (調查) "survey period" (調查期) "transport" (運輸) "wholesale" (批發) CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SECT 2 Quarterly survey of service industries VerDate:24/07/1998 A statistical survey shall be carried out by the Commissioner on the expiration of each survey period in respect of business establishments in Hong Kong for the purpose of compiling statistics relating to- (a) their business receipts; (b) the changes in the book value of their stocks of goods intended for sale; and (c) the changes in the prices of services rendered to customers by them, in the survey period. L.N. 290 of 1998) CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SECT 3 Information required to be given VerDate:30/06/1997 For the purpose of the survey, information in respect of the matters specified in the Schedule shall be given in relation to business establishments in the service industries for the survey period and shall be furnished to the Commissioner in accordance with such form of questionnaire as the Commissioner may issue for that purpose and within such period as he may therein specify. CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SECT 4 Persons required to give information VerDate:30/06/1997 The information required to be given under section 3 in respect of a business establishment shall be given- (a) in the case of a business establishment which is a body corporate, by a director, secretary or other person concerned in the management thereof; (b) in the case of a business establishment which is a partnership, by any partner thereof; (c) in any other case, by the proprietor of the business establishment. CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SECT 5 Survey period VerDate:30/06/1997 For the purpose of this Order, the survey period shall be- (a) the first 3 months of 1994; (b) each period of 3 consecutive months thereafter. CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SECT 6 Sampling methods may be used VerDate:30/06/1997 The use of sampling methods for the collection of information relevant to any survey is hereby authorized. CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SECT 7 Application of Order in certain cases VerDate:30/06/1997 This Order shall apply in relation to a business establishment notwithstanding that it commences business after the commencement of a survey period or ceases to carry on business during that period. CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SECT 8 Date for destruction of schedules VerDate:30/06/1997 All completed schedules collected or received by census officers for a survey and all copies thereof shall be destroyed not later than 2 years after the relevant survey period. CENSUS AND STATISTICS (QUARTERLY SURVEY OF SERVICE INDUSTRIES) ORDER - SCHEDULE SCHEDULE VerDate:24/07/1998 [section 3] MATTERS IN RESPECT OF WHICH INFORMATION IS REQUIRED TO BE GIVEN 1. Name and address of the business establishment. 2. Type of business activity. 3. Business receipts, by type. 4. Number of persons engaged. 5. Book value of stocks of goods intended for sale. (L.N. 290 of 1998) Where information in respect of the above matters is given in relation to business establishments by furnishing a combined questionnaire, the information in respect of items 1, 2 and 4 is required to be given in relation to each business establishment.
