(2) (Omitted as spent) (Enacted 1991) AIR POLLUTION CONTROL (VEHICLE DESIGN STANDARDS) (EMISSION) REGULATIONS - REGULATION 2 Interpretation VerDate:01/08/2001 In these regulations, unless the context otherwise requires- "compression-ignition engine" (壓燃式引擎) means an engine in which the fuel is injected into the cylinders or combustion space of the engine and is there ignited during normal running solely by the heat of compression of the cylinder charge; "Council" (議會) means the Council of the European Communities (now known as the Council of the European Union); (L.N. 37 of 1995) "design weight" (設計重量) means, in relation to a particular motor vehicle, the maximum design loaded vehicle weight recommended by its manufacturer for motor vehicles of the same class or description as the particular vehicle; (L.N. 37 of 1995) "emission" (排放) means emission of any air pollutant; "engine of direct-injection type" (直接噴射式引擎) means a compression-ignition engine in which the fuel is injected directly into the combustion space above the piston crown; (L.N. 96 of 1998) "evaporative emission" (蒸發排放物) means hydrocarbons emitted by evaporation from the fuel system of a motor vehicle which is equipped with a positive-ignition engine; (L.N. 121 of 1999) "liquefied petroleum gas" (石油氣) has the same meaning as in section 2 of the Gas Safety Ordinance (Cap 51); (L.N. 101 of 2001) "motor cycle" (電單車) means a two-wheeled motor vehicle with or without a sidecar; "motor tricycle" (機動三輪車) means a three-wheeled motor vehicle other than- (a) a motor cycle with a sidecar; and (b) a village vehicle; "motor vehicle" (汽車) means any mechanically propelled vehicle; "positive-ignition engine" (強制點火式引擎) means an engine operating on the Otto cycle in which a mixture of fuel and air is drawn into cylinders and ignited after compression by means of an electric spark applied at a known and pre-determined moment of the cycle; "registered" (登記) means first registered under the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374 sub. leg. E); (L.N. 37 of 1995) "special purpose vehicle" (特別用途車輛) means a motor vehicle designed, constructed or adapted primarily for a use other than the carriage on a road of goods, the driver or passengers. "unleaded petrol" (無鉛汽油) has the same meaning as in section 2 of the Air Pollution Control (Motor Vehicle Fuel) Regulation (Cap 311 sub. leg. L); (19 of 1994 s. 13) "vehicle" (車輛) means any vehicle whether or not mechanically propelled which is constructed or adapted for use on roads but does not include a vehicle of the North-west Railway as defined in section 2(1) of the Kowloon-Canton Railway Corporation Ordinance (Cap 372) or a tram. (L.N. 165 of 2005) (2) For the purpose of subregulation (1), smoke shall be deemed excessive if the smoke emitted from the vehicle measured by means of the test procedure specified in the first column of Schedule 1 exceeds the maximum permitted smoke level specified in the second column of that Schedule or the maximum permitted smoke level in absolute units of light absorption specified in the third column of that Schedule. (3) The provisions of this regulation are in addition to, and not in substitution for, regulation 31 of the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374 sub. leg. A). (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to the standards specified in Part I(a), (b) or (c) of Schedule 5; (iii) if it is registered between 1 July 1999 and 31 December 2000 (both dates inclusive), to the standards specified in Part I(a), (b) or (c) of Schedule 7; (L.N. 157 of 2000; L.N. 165 of 2005) (c) every taxi which is equipped with a compression-ignition engine shall be so constructed that the emission from that taxi conforms- (i) if it is registered between 1 January 1992 and 30 September 1998 (both dates inclusive), to the standards specified in Part II(a), (b) or (c) of Schedule 2; (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to the standards specified in Part II(a), (b) or (c) of Schedule 5; (iii) if it is registered between 1 July 1999 and 31 July 2001 (both dates inclusive), to the standards specified in Part II(a), (b) or (c) of Schedule 7; (L.N. 121 of 1999; L.N. 101 of 2001) (ca) every taxi which is equipped with a positive-ignition engine and constructed to operate on liquefied petroleum gas only shall be so constructed that the emission from that taxi conforms- (L.N. 124 of 2003) (i) if it is registered between 1 August 2001 and 31 July 2003 (both dates inclusive), to the standards specified in Part I(a), (b) or (c) of Schedule 10A; (ii) if it is registered between 1 August 2003 and 31 December 2005 (both dates inclusive), to the standards specified in Part II(a), (b) or (c) of Schedule 10A; (L.N. 101 of 2001; L.N. 124 of 2003; L.N. 165 of 2005) (d) every goods vehicle or light bus which is equipped with a positive-ignition engine and constructed to operate on unleaded petrol only and which has a design weight of not more than 1.7 tonnes shall be so constructed that the emission from that goods vehicle or light bus conforms- (L.N. 124 of 2003) (i) if it is registered between 1 January 1992 and 30 September 1998 (both dates inclusive), to the standards specified in Part III(a), (b) or (c) of Schedule 2; (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to the standards specified in Part III(a), (b) or (c) of Schedule 5; (iii) if it is registered between 1 July 1999 and 31 December 2000 (both dates inclusive), to the standards specified in Part III(a), (b) or (c) of Schedule 7; (L.N. 121 of 1999; L.N. 157 of 2000) (iv) if it is registered between 1 January 2001 and 31 December 2001 (both dates inclusive), to the standards specified in Part III(a), (b) or (c) of Schedule 10; and (iv) is registered between 1 August 2003 and 31 December 2005 (both dates inclusive), (L.N. 165 of 2005) shall be so constructed that the emission from that light bus conforms to the standards specified in Part I(a), (b) or (c) of Schedule 10C; (L.N. 124 of 2003) (e) every goods vehicle or light bus which is equipped with a compression-ignition engine and which has a design weight of not more than 1.7 tonnes shall be so constructed that the emission from that goods vehicle or light bus conforms- (i) if it is registered between 1 January 1992 and 30 September 1998 (both dates inclusive), to the standards specified in Part IV(a), (b) or (c) of Schedule 2; (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to the standards specified in Part IV(a) or (b) of Schedule 5; (iii) if it is registered between 1 July 1999 and 31 December 2000 (both dates inclusive), to the standards specified in Part IV(a), (b) or (c) of Schedule 7; (L.N. 121 of 1999; L.N. 157 of 2000) (iv) if it is registered between 1 January 2001 and 31 December 2001 (both dates inclusive), to the standards specified in Part IV(a), (b) or (c) of Schedule 10; (L.N. 157 of 2000; L.N. 102 of 2001) (v) if it is registered between 1 January 2002 and 31 December 2005 (both dates inclusive), to the standards specified in Part III(a) or (b) of Schedule 10B; (L.N. 102 of 2001; L.N. 165 of 2005) (f) every goods vehicle or light bus which is equipped with a positive-ignition engine and constructed to operate on unleaded petrol only and which has a design weight of more than 1.7 tonnes but not more than 2.5 tonnes shall be so constructed that the emission from that goods vehicle or light bus conforms- (L.N. 124 of 2003) (i) if it is registered between 1 January 1992 and 30 September 1998 (both dates inclusive), to the standards specified in Part V(a), (b) or (c) of Schedule 2; (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to standards specified in Part V(a), (b) or (c) of Schedule 5; (iii) if it is registered between 1 July 1999 and 31 December 2000 (both dates inclusive), to the standards specified in Part V(a), (b) or (c) of Schedule 7; (L.N. 121 of 1999; L.N. 157 of 2000) (iv) if it is registered between 1 January 2001 and 31 December 2001 (both dates inclusive), to the standards specified in Part V(a), (b) or (c) of Schedule 10; (L.N. 157 of 2000; L.N. 102 of 2001) (v) if it is registered between 1 January 2002 and 31 December 2005 (both dates inclusive), to the standards specified in Part IV(a), (b) or (c) of Schedule 10B; (L.N. 102 of 2001; L.N. 165 of 2005) (fa) every light bus which- (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on liquefied petroleum gas only; (iii) has a design weight of more than 1.7 tonnes but not more than 2.5 tonnes; and (iv) is registered between 1 August 2003 and 31 December 2005 (both dates inclusive), (L.N. 165 of 2005) shall be so constructed that the emission from that light bus conforms to the standards specified in Part II(a), (b) or (c) of Schedule 10C; (L.N. 124 of 2003) (g) every goods vehicle or light bus which is equipped with a compression-ignition engine and which has a design weight of more than 1.7 tonnes but not more than 2.5 tonnes shall be so constructed that the emission from that goods vehicle or light bus conforms- (i) if it is registered between 1 January 1992 and 30 September 1998 (both dates inclusive), to the standards specified in Part VI(a), (b) or (c) of Schedule 2; (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to the standards specified in Part VI(a) or (b) of Schedule 5; (iii) if it is registered between 1 July 1999 and 31 December 2000 (both dates inclusive), to the standards specified in Part VI(a), (b) or (c) of Schedule 7; (L.N. 121 of 1999; L.N. 157 of 2000) (iv) if it is registered between 1 January 2001 and 31 December 2001 (both dates inclusive), to the standards specified in Part VI(a), (b) or (c) of Schedule 10; (L.N. 157 of 2000; (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to the standards specified in Part VII(a), (b) or (c) of Schedule 5; (iii) if it is registered between 1 July 1999 and 31 December 2000 (both dates inclusive), to the standards specified in Part VII(a), (b) or (c) of Schedule 7; (L.N. 121 of 1999; L.N. 157 of 2000) (iv) if it is registered between 1 January 2001 and 31 December 2001 (both dates inclusive), to the standards specified in Part VII(a), (b) or (c) of Schedule 10; (L.N. 124 of 2003) (i) every goods vehicle or light bus which is equipped with a compression-ignition engine and which has a design weight of more than 2.5 tonnes but not more than 3.5 tonnes shall be so constructed that the emission from that goods vehicle or light bus conforms- (i) if it is registered between 1 April 1995 and 30 September 1998 (both dates inclusive), to the standards specified in Part II(a) or (b) of Schedule 3; (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to the standards specified in Part VIII(a) or (b) of Schedule 5; (iii) if it is registered between 1 July 1999 and 31 December 2000 (both dates inclusive), to the standards specified in Part VIII(a) or (b) of Schedule 7; (L.N. 121 of 1999; L.N. 157 of 2000) (iv) if it is registered between 1 January 2001 and 31 December 2001 (both dates inclusive), to the standards specified in Part VIII(a) or (b) of Schedule 10; (L.N. 157 of 2000; (ii) if it is registered between 1 October 1998 and 30 June 1999 (both dates inclusive), to the standards specified in Part IX(a) or (b) of Schedule 5; (iii) if it is registered between 1 July 1999 and 30 September 2001 (both dates inclusive), to the standards specified in Part IX(a) or (b) of Schedule 7; (L.N. 121 of 1999; L.N. 102 of 2001) (iv) if it is registered between 1 October 2001 and 31 July 2003 (both dates inclusive), to the standards specified in Part I(a) or (b) of Schedule 6A; (L.N. 102 of 2001; L.N. 124 of 2003) (v) if it is registered between 1 August 2003 and 30 September 2006 (both dates inclusive), to the standards specified in Part III(a) or (b) of Schedule 6A; (L.N. 124 of 2003; L.N. 111 of 2006) (ja) every light bus which- (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on liquefied petroleum gas only; (iii) has a design weight of more than 3.5 tonnes; and (iv) is registered between 1 August 2003 and 30 September 2006 (both dates inclusive), (L.N. 111 of 2006) shall have such engine so constructed that the emission from that light bus conforms to the standards specified in Part IV(a) or (b) of Schedule 10C; (L.N. 124 of 2003) (k) every goods vehicle or bus which is equipped with a compression-ignition engine and which has a design weight of more than 3.5 tonnes but not more than 4 tonnes shall have such engine so constructed that the emission from that goods vehicle or bus conforms- (L.N. 124 of 2003) (i) if it is registered between 1 April 1995 and 30 September 1998 (both dates inclusive), to the standards specified in Part IV(a) or (b) of Schedule 3; (ii) if it is registered between 1 October 1998 and 30 September 2001 (both dates inclusive), to the standards specified in paragraph (a) or (b) of Schedule 6; (L.N. 102 of 2001) (iii) if it is registered between 1 October 2001 and 30 September 2006 (both dates inclusive), to the standards specified in Part II(a) or (b) of Schedule 6A; (L.N. 124 of 2003; L.N. 111 of 2006) (ka) every light bus which is equipped with a compression-ignition engine and which has a design weight of more than 3.5 tonnes but not more than 4 tonnes shall have such engine so constructed that the emission from that light bus conforms- (i) if it is registered between 1 April 1995 and 30 September 1998 (both dates inclusive), to the standards specified in Part IV(a) or (b) of Schedule 3; (ii) if it is registered between 1 October 1998 and 31 July 2003 (both dates inclusive), to the standards specified in paragraph (a) or (b) of Schedule 6; (iii) if it is registered between 1 August 2003 and 30 September 2006 (both dates inclusive), to the standards specified in Part II(a) or (b) of Schedule 6A; (L.N. 124 of 2003; L.N. 111 of 2006) (l) every goods vehicle, light bus or bus which is equipped with a compression-ignition engine and which has a design weight of more than 4 tonnes shall have such engine so constructed that the emission from that goods vehicle, light bus or bus conforms- (i) if it is registered between 1 April 1995 and 30 September 1998 (both dates inclusive), to the standards specified in Part IV(c) or (d) of Schedule 3; (ii) if it is registered between 1 October 1998 and 30 September 2001 (both dates inclusive), to the standards specified in paragraph (a) or (b) of Schedule 6; (L.N. 102 of 2001) (iii) if it is registered between 1 October 2001 and 30 September 2006 (both dates inclusive), to the standards specified in Part II(a) or (b) of Schedule 6A; (L.N. 102 of 2001; L.N. 111 of 2006) (m) every motor cycle registered between 1 October 1999 and 31 December 2006 (both dates inclusive) shall be so constructed that the emission from that motor cycle conforms to the standards specified in paragraph (a), (b) or (c) of Schedule 8; (L.N. 121 of 1999; L.N. 111 of 2006) (n) every motor tricycle registered between 1 October 1999 and 31 December 2006 (both dates inclusive) shall be so constructed that the emission from that motor tricycle conforms to the standards specified in Schedule 9. (L.N. 121 of 1999; L.N. 111 of 2006) (2) In this regulation, "private car" (私家車), "taxi" (的士), "goods vehicle" (貨車), "light bus" (小型巴士) and "bus" (巴士) shall have the meanings assigned to them, respectively, in section 2 of the Road Traffic Ordinance (Cap 374). (L.N. 96 of 1998; L.N. 121 of 1999) AIR POLLUTION CONTROL (VEHICLE DESIGN STANDARDS) (EMISSION) REGULATIONS - REGULATION 7A (Repealed L.N. 96 of 1998) VerDate:01/04/1998 AIR POLLUTION CONTROL (VEHICLE DESIGN STANDARDS) (EMISSION) REGULATIONS - SECT 7B Vehicle design standards for certain motor vehicles registered on or after 1 January 2006 VerDate:01/10/2006 (1) Subject to regulation 9— (a) every private car or taxi which— (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on unleaded petrol only; (iii) has a design weight of not more than 2.5 tonnes; and (iv) is registered on or after 1 January 2006, shall be so constructed that the emission from that private car or taxi conforms to the standards specified in paragraph (a), (b) or (c) of Schedule 12; (b) every private car or taxi which— (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on unleaded petrol only; (iii) has a design weight of more than 2.5 tonnes; and (iv) is registered between 1 January 2006 and 31 December 2006 (both dates inclusive), shall be so constructed that the emission from that private car or taxi conforms to the standards specified in Part I(a), (b) or (c) of Schedule 10B; (c) every private car or taxi which— (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on unleaded petrol only; (iii) has a design weight of more than 2.5 tonnes; and (iv) is registered on or after 1 January 2007, shall be so constructed that the emission from that private car or taxi conforms to the standards specified in paragraph (a), (b) or (c) of Schedule 12; (d) every private car which— (i) is equipped with a compression-ignition engine; and (ii) is registered on or after 1 January 2006, shall be so constructed that the emission from that private car conforms to the standards specified in paragraph (b) of Schedule 12; (e) every taxi which— (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on liquefied petroleum gas only; and (iii) is registered on or after 1 January 2006, shall be so constructed that the emission from that taxi conforms to the standards specified in paragraph (a), (b) or (c) of Schedule 12; (f) every goods vehicle or light bus which— (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on unleaded petrol only; (iii) has a design weight of not more than 1.7 tonnes; (g) every goods vehicle or light bus which— (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on unleaded petrol only; (iii) has a design weight of more than 1.7 tonnes but not more than 2.5 tonnes; and (iv) is registered between 1 January 2006 and 31 December 2006 (both dates inclusive), shall be so constructed that the emission from that goods vehicle or light bus conforms to the standards specified in Part IV(a), (b) or (c) of Schedule 10B; (h) every goods vehicle or light bus which— (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on unleaded petrol only; (iii) has a design weight of more than 2.5 tonnes but not more than 3.5 tonnes; and (iv) is registered between 1 January 2006 and 31 December 2006 (both dates inclusive), shall be so constructed that the emission from that goods vehicle or light bus conforms to the standards specified in Part VI(a), (b) or (c) of Schedule 10B; (i) every goods vehicle or light bus which— (i) is equipped with a positive-ignition engine; (ii) is constructed to operate on unleaded petrol only; (iii) has a design weight of not more than 3.5 tonnes; Part VII Emission shall not exceed- (a) non-methane organic gases 0.121 gram per kilometre carbon monoxide 3.1 grams per kilometre oxides of nitrogen 0.37 gram per kilometre as measured by the 1975 Federal Test Procedure administered by the Environmental Protection Agency of the United States of America; and evaporative emission shall not exceed 2.5 grams per test as measured by the California Sealed Housing for Evaporative Emissions Determination test procedure administered by the Environmental Protection Agency of the United States of America; (b) hydrocarbons 1.80 grams per kilowatt-hour carbon monoxide 51.0 grams per kilowatt-hour oxides of nitrogen 4.50 grams per kilowatt-hour as measured by the 13-mode operation for heavy duty petrol-powered motor vehicles administered by the Ministry of Transport of Japan; and evaporative emission shall not exceed 2.0 grams per test as measured by the Japan Sealed Housing for Evaporative Emissions Determination test administered by the Ministry of Transport of Japan; (c) (i) for a vehicle with a reference mass not exceeding 1305 kg- hydrocarbons 0.20 gram per kilometre carbon monoxide 2.3 grams per kilometre oxides of nitrogen 0.15 gram per kilometre as measured by the Type I test procedure specified in Council Directive 70/220/EEC as amended by Council Directive 98/69/EC, both made by the Council; and evaporative emission shall not exceed 2.0 grams per test as measured by the Type IV test procedure specified in Council Directive 98/69/EC made by the Council; (ii) for a vehicle with a reference mass of more than 1250 kg but not more than 1700 kg- hydrocarbons and oxides of 0.6 gram per kilometre nitrogen combined carbon monoxide 4.0 grams per kilometre (iii) for a vehicle with a reference mass of more than 1700 kg- hydrocarbons and oxides of 0.7 gram per kilometre nitrogen combined carbon monoxide 5.0 grams per kilometre as measured by the Type I test procedure specified in Council Directive 70/220/EEC as amended by Council Directive 96/69/EC, both made by the Council; and evaporative emission shall not exceed 2.0 grams per test as measured by the Type IV test procedure specified in Council Directive 91/441/EC made by the Council. Part IV Emission shall not exceed- (a) non-methane organic gases 0.062 gram per kilometre carbon monoxide 2.73 grams per kilometre oxides of nitrogen 0.25 gram per kilometre as measured by the 1975 Federal Test Procedure administered by the Environmental Protection Agency of the United States of America; and evaporative emission shall not exceed 2.0 grams per test as measured by the California Sealed Housing for Evaporative Emissions Determination test procedure administered by the Environmental Protection Agency of the United States of America; (b) hydrocarbons 0.08 gram per kilometre carbon monoxide 2.10 grams per kilometre oxides of nitrogen 0.13 gram per kilometre as measured by the 10.15-mode operation administered by the Ministry of Land, Infrastructure and Transport of Japan; and evaporative emission shall not exceed 2.0 grams per test as measured by the Japan Sealed Housing for Evaporative Emissions Determination test administered by the Ministry of Land, Infrastructure and Transport of Japan; (c) (i) for a vehicle the reference mass of which does not exceed 1305 kg- hydrocarbons 0.20 gram per kilometre carbon monoxide 2.3 grams per kilometre oxides of nitrogen 0.15 gram per kilometre as measured by the Type I test procedure specified in Council Directive 70/220/EEC as amended by Council Directive 1999/102/EC, both made by the Council; and evaporative emission shall not exceed 2.0 grams per test as measured by the Type IV test procedure specified in Council Directive 1999/102/EC made by the Council; (ii) for a vehicle the reference mass of which exceeds 1305 kg but does not exceed 1760 kg- hydrocarbons 0.25 gram per kilometre carbon monoxide 4.17 grams per kilometre oxides of nitrogen 0.18 gram per kilometre as measured by the Type I test procedure specified in Council Directive 70/220/EEC as amended by Council Directive 1999/102/EC, both made by the Council; and evaporative emission shall not exceed 2.0 grams per test as measured by the Type IV test procedure specified in Council Directive 1999/102/EC made by the Council; (iii) for a vehicle the reference mass of which exceeds 1760 kg- hydrocarbons 0.29 gram per kilometre carbon monoxide 5.22 grams per kilometre oxides of nitrogen 0.21 gram per kilometre as measured by the Type I test procedure specified in Council Directive 70/220/EEC as amended by Council Directive 1999/102/EC, both made by the Council; and evaporative emission shall not exceed 2.0 grams per test as measured by the Type IV test procedure specified in Council Directive 1999/102/EC made by the Council.
