IMPORT AND EXPORT (FEES) REGULATIONS - REGULATION 2 Prescribed fees and manner of payment VerDate:25/06/2007 (1) The fees specified in the third column of the Schedule shall be the fees to be collected by the Director in respect of the matters specified in the second column of the Schedule. (L.N. 388 of 1983) (2) The fees set out in items 1(c), 4(a) and 14 of the Schedule shall be paid- (a) where the application or lodgement is made on paper- (i) in cash or through a payment system known as the Easy Pay System provided by the Electronic Payment Services Company (HK) Limited; or (ii) in the form of adhesive postage stamps or impressed postage stamps of the total value indicated in that item affixed or franked, as the case may be, on the application or production notification; or (L.N. 128 of 2001) (b) where the application or lodgement is made using services provided by a specified body, in the manner agreed by the Government and the specified body. (L.N. 81 of 1975; L.N. 258 of 1982; L.N. 543 of 1995) (2A) The fee set out in item 13A of the Schedule shall be paid before the delivery of an import notification, an export notification or a transhipment notification under the Import and Export (General) Regulations (Cap 60 sub. leg. A). (L.N. 25 of 2007) (3) The Director may collect fees for items 12 and 13 of the Schedule pro rata on a monthly basis- (L.N. 156 of 2004) (a) on a person making an application for the purpose; and (b) if the Director is satisfied that it will enable the registration of that applicant in respect of each of those items to have the same expiry date, being a date determined by the Director. (L.N. 81 of 1975; L.N. 258 of 1982; L.N. 543 of 1995) IMPORT AND EXPORT (FEES) REGULATIONS - REGULATION 3 (Ceased to have effect) VerDate:15/05/2008 (Ceased to have effect) IMPORT AND EXPORT (FEES) REGULATIONS - REGULATION 3 Transitional arrangement relating to Import and Export (General) (Amendment) Regulation 2006 (refund of certain registration fees) VerDate:15/05/2006 (1) This regulation applies to a person who— (a) before regulation 6DB(1A) of the Import and Export (General) Regulations (Cap 60 sub. leg. A) (“relevant Regulations”) comes into operation (“relevant time”), has paid a fee for registration (“registration fee”) as a registered rough diamond trader under regulation 6DD of the relevant Regulations for a period that expires after the relevant time; and (b) after the relevant time, is a person to whom regulation 6DB(1) of the relevant Regulations does not apply by virtue of regulation 6DB(1A) of the relevant Regulations. (2) A person to whom this regulation applies may apply in writing to the Director for refund of the appropriate part of the registration fee. (3) If the Director is satisfied that the person who makes an application under paragraph (2) (“applicant”) is a person to whom this regulation applies, he shall refund the appropriate part of the registration fee to the applicant. (4) Upon refunding the appropriate part of the registration fee to the applicant, the Director shall— (a) remove the name of the applicant from the register maintained under regulation 6DC of the relevant Regulations; and (b) send a notice to the applicant informing him that his name has been so removed. (5) In this regulation, the amount of the appropriate part of the registration fee shall be— (a) where the date of notice referred to in paragraph (4)(b) (“notification date”) is within one year from the date of registration, $275; and (b) where the notification date is more than one year from the date of registration, a sum calculated in accordance with the following formula, with the result rounded up to the nearest dollar— A $275 X 365 where A represents the number of calendar days within the period that begins on the notification date and expires on the date of expiration of the registration. (6) This regulation ceases to have effect on the second anniversary of the day on which the Import and Export (Fees) (Amendment) Regulation 2006 (L.N. 50 of 2006) comes into operation*.
