FACTORIES AND INDUSTRIAL UNDERTAKINGS (SAFETY MANAGEMENT) REGULATION - SECT 26

Disciplinary board panel

For the saving and transitional provisions relating to the amendments made by
the Resolution of the Legislative Council (L.N. 130 of 2007), see paragraph
(12) of that Resolution.

(1) The Secretary for Labour and Welfare shall appoint members to a
disciplinary board panel based on the following numbers and categories- (L.N.
106 of 2002; L.N. 130 of 2007)

   (a)  not more than 5 persons from organizations that he considers represent
        the interests of registered safety auditors;

   (b)  not more than 5 persons from organizations that he considers represent
        the interests of registered scheme operators;

   (c)  not more than 5 persons from organizations that he considers represent
        the interests of employers in the construction industry;

   (d)  not more than 5 persons from organizations that he considers represent
        the interests of employers in industries other than the construction
        industry;

   (e)  not more than 5 persons from organizations that he considers represent
        the interests of employees in the construction industry;

   (f)  not more than 5 persons from organizations that he considers represent
        the interests of employees in industries other than the construction
        industry.

(2) A public officer is not eligible for appointment to the
disciplinary board panel.

(3) A member shall be appointed for a term of 3 years and may be reappointed
at the end of any term.
