Refund of application fees for registration: when registration is less than 36 months

REFUND OF FEES

(1) If—

   (a)  the Registrar accepts an application for registration; and

   (b)  the expiry date specified under section 44(1) of the Ordinance for the
        registration is less than 36 months after the date of registration,
        (L.N. 205 of 2005) the Registrar shall make a refund of the fee paid
        in respect of the application or a portion of such fee.

(2) Subject to subsection (7), if the application is made within the
first period, the amount to be refunded under subsection (1) is calculated in
accordance with the following formula, with the result rounded up to the
nearest dollar— F —— × [852 – (D – 243)].

(3) Subject to subsection (7), if the application is made within the
second period, the amount to be refunded under subsection (1) is calculated in
accordance with the following formula, with the result rounded up to the
nearest dollar— F —— × [912 – (D – 183)].

(4) Subject to subsection (7), if the application is made within the
third period, the amount to be refunded under subsection (1) is calculated in
accordance with the following formula, with the result rounded up to the
nearest dollar— F —— × [973 – (D – 122)]. 973

(5) Subject to subsection (7), if the application is made within the
fourth period, the amount to be refunded under subsection (1) is calculated in
accordance with the following formula, with the result rounded up to the
nearest dollar— F —— × [1034 – (D – 61)]. 1034

(6) If the application is made at any other time, the amount to be refunded
under subsection (1) is calculated in accordance with the following formula,
with the result rounded up to the nearest dollar— F —— × (1095 – D).

(7) If the amount to be refunded under subsection (1) as calculated in
accordance with the formula set out in subsection (2), (3), (4) or (5) is
larger than the amount of fee paid in respect of the application, the amount
to be so refunded is the amount of fee so paid.

(8) In the formulae set out in subsections (2), (3), (4), (5) and

(6)—

   (a)  F represents the amount of fee paid in respect of the application; and

   (b)  D represents the number of days within the period that begins on the
        date of registration and expires at the end of the expiry date
        specified under section 44(1) of the Ordinance for the registration.
