ENTERTAINMENT SPECIAL EFFECTS (GENERAL) REGULATION - SECT 28

Offences under this Part

(1) Where a conveyance permit is not required for the conveyance of
pyrotechnic special effects materials under section 23, a special effects
operator who fails to comply with section 23(3)(d)(i) or (ii) commits an
offence and is liable to a fine at level 2.

(2) The owner or person in charge of any vehicle or any person in possession
of pyrotechnic special effects materials in respect of which section 24 or 27
is contravened commits an offence and is liable to a fine at level 4 and to
imprisonment for 1 month.

(3) The owner, agent or master of any vessel or any person in possession of
pyrotechnic special effects materials in respect of which section 25(1) is
contravened commits an offence and is liable to a fine at level 4 and to
imprisonment for 1 month.

(4) A person who contravenes section 26 commits an offence and is liable to a
fine at level 4 and to imprisonment for 1 month.

(5) In any proceedings for a contravention of section 24, 25(1), 26 or 27, it
shall be a defence for the person charged to prove that he did not know and
could not with reasonable diligence have known the nature of the materials in
question.
