ELECTORAL AFFAIRS COMMISSION (ELECTORAL PROCEDURE) (DISTRICT COUNCILS) REGULATION - SECT 81

Returning Officer to declare election result

(1) When the counting of the votes and re-counts, if any, are completed and
the result of the election determined, subject to subsection

(2), the Returning Officer must declare the candidate who is successful at the
election to be elected, as provided in section 41(4) of the District 
Councils Ordinance ( Cap 547). (L.N. 125 of 2003 and L.N. 191 of 2003)

(2) If, before a successful candidate at an election is declared to be
elected, it is proved to the satisfaction of the Returning Officer that the
candidate has died or is disqualified, that Officer must not declare the
candidate to be elected and must declare the election to have failed, as
provided in section 40(3) of the District Councils Ordinance ( Cap  547).
