UNITED NATIONS SANCTIONS (LIBYA) (PROHIBITION OF FLIGHTS) REGULATION - SECT 1 (Repealed L.N. 23 of 2004) VerDate:13/02/2004 UNITED NATIONS SANCTIONS (LIBYA) (PROHIBITION OF FLIGHTS) REGULATION - SECT 1 Interpretation VerDate:22/08/1997 (1) In this Regulation, unless the context otherwise requires- "commander" (機長), in relation to an aircraft, means the member of the flight crew designated as commander of the aircraft by the operator thereof, or, failing such a person, the person who is for the time being the pilot in command of the aircraft; "HKSAR" (特區) means the Hong Kong Special Administrative Region of the People's Republic of China; "operator" (營運人), in relation to an aircraft, means the person for the time being having the management of the aircraft. (2) No permission shall be granted under this Regulation except with the approval of the instructing authority given generally or in a particular case. "commander" (機長), in relation to an aircraft, means the member of the flight crew designated as commander of the aircraft by the operator thereof, or, failing such a person, the person who is for the time being the pilot in command of the aircraft; "HKSAR" (特區) means the Hong Kong Special Administrative Region of the People's Republic of China; "operator" (營運人), in relation to an aircraft, means the person for the time being having the management of the aircraft. UNITED NATIONS SANCTIONS (LIBYA) (PROHIBITION OF FLIGHTS) REGULATION - SECT 2 (Repealed L.N. 23 of 2004) VerDate:13/02/2004 UNITED NATIONS SANCTIONS (LIBYA) (PROHIBITION OF FLIGHTS) REGULATION - SECT 2 Prohibition of flights VerDate:22/08/1997 (1) Except with the permission of the Chief Executive granted under this section no aircraft, wherever registered, shall take off from, land in or fly over the HKSAR if its destination is, or if it has taken off from, Libya. (2) If any aircraft is used in contravention of the provisions of this section, then the operator and the commander of the aircraft shall be guilty of an offence. UNITED NATIONS SANCTIONS (LIBYA) (PROHIBITION OF FLIGHTS) REGULATION - SECT 3 (Repealed L.N. 23 of 2004) VerDate:13/02/2004 UNITED NATIONS SANCTIONS (LIBYA) (PROHIBITION OF FLIGHTS) REGULATION - SECT 3 Penalties and proceedings VerDate:22/08/1997 (1) Any person guilty of an offence under this Regulation shall be liable- (a) on conviction on indictment to a fine and to imprisonment for 2 years; (b) on summary conviction to a fine at level 6 and to imprisonment for 6 months. (2) Where any body corporate is guilty of an offence under this Regulation, and that offence is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other similar officer of the body corporate or any person who was purporting to act in any such capacity, he, as well as the body corporate, shall be guilty of that offence and shall be liable to be proceeded against and punished accordingly. (3) No proceedings for an offence under this Regulation shall be instituted in the HKSAR except by or with the consent of the Secretary for Justice. UNITED NATIONS SANCTIONS (LIBYA) (PROHIBITION OF FLIGHTS) REGULATION - SECT 4 (Repealed L.N. 23 of 2004) VerDate:13/02/2004 UNITED NATIONS SANCTIONS (LIBYA) (PROHIBITION OF FLIGHTS) REGULATION - SECT 4 Exercise of powers of the Chief Executive VerDate:22/08/1997 (1) The Chief Executive may to such extent and subject to such restrictions and conditions as he may think proper, delegate or authorize the delegation of any of his powers under this Regulation to any person, or class or description of persons, approved by him, and references in this Regulation to the Chief Executive shall be construed accordingly. (2) Any permissions granted under this Regulation may be either general or special, may be subject to or without conditions, may be limited so as to expire on a specified date unless renewed and may be varied or revoked by the Chief Executive.
