Award of costs in proceedings before Registrar under section 49 of the Ordinance

If, in proceedings before the Registrar under section 49 of the Ordinance, the
proprietor of a patent offers to surrender it under section 48 of the
Ordinance, the Registrar shall, in deciding whether costs should be awarded to
the person referring the question as to whether an invention is a patentable
invention, consider whether proceedings might have been avoided if the person
referring the question had given reasonable notice to the proprietor before
the question was referred.
