ESTATE AGENTS (DETERMINATION OF COMMISSION DISPUTES) REGULATION - SECT 8

Conduct of determination proceedings

(1) The adjudicator may, subject to the widest discretion allowed by law,
conduct the determination proceedings in such manner as he considers
appropriate and shall have the power to adopt, whenever possible, simplified
or expedited procedure and to conduct proceedings to ensure the just,
expeditious and economical determination of the dispute, provided that the
parties are treated with equality and that at any stage of the proceedings
each party is given a full opportunity of presenting his case.

(2) Without prejudice to the generality of subsection (1), the adjudicator may
in conducting determination proceedings decide whether and to what extent he
should take the initiative in ascertaining the facts and the law relevant to
those proceedings.
