FREIGHT CONTAINERS (SAFETY) (EXAMINATION PROCEDURE) ORDER - SECT 11

Duties of competent person if he found defects in container after examination

(1) If having carried out an examination, he is of the opinion that a
container has any defect which could result in prejudice to the health or
safety of any person, the competent person shall determine whether the
container can be made safe for the purpose of proceeding to its destination.

(2) Having made a determination under subsection (1), the competent  person
shall immediately notify-

   (a)  the person who is in charge of or who has custody of the container;

   (b)  the owner if the owner is not in charge of or does not have custody of
        the container; and

   (c)  the Director, in writing of his determination.
