TSING MA CONTROL AREA (GENERAL) REGULATION - CHAPTER 498B TSING MA CONTROL AREA (GENERAL) REGULATION - LONG TITLE Empowering section VerDate:30/06/1997 (Cap 498 section 27(2)) [22 May 1997] L.N. 269 of 1997 (L.N. 244 of 1997) TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 1 Interpretation VerDate:30/06/1997 PART I PRELIMINARY In this Regulation, unless the context otherwise requires- "appropriate toll" (適當使用費) has the same meaning as in the Tolls Regulation; "autotoll booth" (自動收費亭) has the same meaning as in the Tolls Regulation; "electronic toll pass" (電子收費代用證) has the same meaning as in the Tolls Regulation; "lane" (行車綫) means a lane for the passage of traffic within the Area; "light signal" (交通燈) has the same meaning as in the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.); "nearside lane" (左邊行車綫) means the left most lane (in relation to the direction of traffic) in any road within the Area; "prescribed light signal" (訂明交通燈) means a light signal of the size, design, colour and type prescribed in Schedule 1 or under the Road Traffic (Traffic Control) Regulations (Cap 374 sub. leg.); "prescribed road marking" (訂明道路標記) means a road marking of the size, colour and type prescribed in Schedule 2 or under the Road Traffic Ordinance (Cap 374) or its subsidiary legislation; "prescribed traffic sign" (訂明交通標誌) means a traffic sign of the size, colour and type prescribed in Schedule 1 or under the Road Traffic Ordinance (Cap 374) or its subsidiary legislation; "road marking" (道路標記) has the same meaning as in the Road Traffic Ordinance (Cap 374); "toll ticket" (使用費代用券) has the same meaning as in the Tolls Regulation; "Tolls Regulation" (使用費規例) means the Tsing Ma Control Area (Tolls, Fees and Charges) Regulation (Cap 498 sub. leg.); "traffic sign" (交通標誌) has the same meaning as in the Road Traffic Ordinance (Cap 374); "utility" (公用事業設施) means any electric power cable, telephone cable or other cable used in communication, any telecommunications apparatus, any pipe used for the supply of water, gas or oil, or for drainage or sewage, together with any duct for such cable or pipe and any apparatus or works ancillary to such cable, apparatus, pipe or duct; "wind susceptible vehicle" (受風車輛) means a vehicle with an overall height exceeding 1.6 m, a motor cycle or a motor tricycle. "appropriate toll" (適當使用費) "autotoll booth" (自動收費亭) "electronic toll pass" (電子收費代用證) "lane" (行車綫) "light signal" (交通燈) "nearside lane" (左邊行車綫) "prescribed light signal" (訂明交通燈) "prescribed road marking" (訂明道路標記) "prescribed traffic sign" (訂明交通標誌) "road marking" (道路標記) "toll ticket" (使用費代用券) "Tolls Regulation" (使用費規例) "traffic sign" (交通標誌) "utility" (公用事業設施) "wind susceptible vehicle" (受風車輛) TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 2 Prescribed traffic signs, prescribed light signals and prescribed road markings VerDate:30/06/1997 PART II TRAFFIC CONTROL (1) The Commissioner may- (a) erect or display any prescribed traffic sign or prescribed light signal; or (b) place any prescribed road marking, at any place within the Area. (2) The meaning of a traffic sign or light signal prescribed in Schedule 1 or a road marking prescribed in Schedule 2 shall be in accordance with such sign, signal or marking and the note, if any, relating thereto in Schedule 1 or 2, as may be appropriate. (3) The Commissioner may- (a) revoke any traffic sign, light signal or road marking erected, displayed or placed under this Regulation; or (b) vary or temporarily suspend the operation of such a traffic sign, light signal or road marking by covering it or erecting, displaying or placing another traffic sign, light signal or road marking. (4) An operator may, for the purpose of discharging his duties and obligations under a management agreement, exercise any power of the Commissioner under subsection (1) or (3) in respect of any prescribed traffic sign, prescribed light signal or prescribed road marking specified by the Commissioner for the time being. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 3 Advisory traffic signs, light signals and road markings VerDate:30/06/1997 The Commissioner, or an operator with the approval of the Commissioner, may, for the guidance of the people using the Area- (a) erect or display any advisory traffic sign or light signal; or (b) place any advisory road marking, within the Area, with advice and information relating to the use of the Area. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 4 Size, colour and type of traffic signs, light signals and road markings VerDate:30/06/1997 Any traffic sign, light signal or road marking erected, displayed or placed under section 3 must be of such size, colour and type as the Commissioner considers appropriate. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 5 Power to remove unauthorized traffic signs, light signals and road markings VerDate:30/06/1997 Where a person erects, displays or places a traffic sign, light signal or road marking within the Area, without the prior consent in writing of the Commissioner, the Commissioner may- (a) order the person who erected, displayed or placed it to remove it; and (b) if that person does not comply with the order, remove or direct an operator to remove the traffic sign, light signal or road marking. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 6 Variation to traffic signs, light signals and road markings VerDate:30/06/1997 (1) The Commissioner may vary any figure or the direction of an arrow on or in relation to any prescribed traffic sign, prescribed light signal or prescribed road marking to adapt that traffic sign, light signal or road marking to the particular circumstances of the Area. (2) An operator may, for the purpose of discharging his duties and obligations under a management agreement, exercise the power of the Commissioner under subsection (1) in respect of any prescribed traffic sign, prescribed light signal or prescribed road marking specified by the Commissioner for the time being. (3) Where a traffic sign, light signal or road marking erected, displayed or placed for the purposes of this Regulation varies or differs in size, colour or type from the relevant prescribed traffic sign, prescribed light signal or prescribed road marking, the variation or difference shall not prevent the traffic sign, light signal or road marking from being treated as a prescribed traffic sign, prescribed light signal or prescribed road marking if the variation or difference does not materially impair its appearance. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 7 Barriers and gates VerDate:30/06/1997 (1) Where the Commissioner or an operator considers that a road diversion, or the total or partial closure of any road is necessary, the Commissioner or the operator, as the case may be, may position across any road within the Area, a barrier or gate of a size, colour and type as the Commissioner considers appropriate. (2) Where a barrier or gate has been positioned across the road under subsection (1), a person shall not drive a vehicle beyond that barrier or gate. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 8 Toll bars VerDate:30/06/1997 The Commissioner or an operator may position across a toll lane within the Area a toll bar of a size, colour and type that the Commissioner considers appropriate for the purpose of indicating that the toll lane is closed and that the toll booth or autotoll booth in respect of that toll lane is not in use. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 9 Obligation to obey traffic sign, light signals and road markings VerDate:30/06/1997 Any person within the Area shall comply with the prescribed traffic signs, prescribed light signals and prescribed road markings erected, displayed or placed within the Area unless he is exempted from doing so under section 23. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 10 Temporary speed limits VerDate:30/06/1997 (1) Where the Commissioner or an operator considers that there is or likely to be a risk of danger to the public or of damage to or on any road or structure, the Commissioner or the operator, as the case may be, may at any time and without notice, erect or display within the Area, a traffic sign or light signal of such size, colour and type as he considers appropriate for the purpose of fixing a temporary speed limit for vehicles using that road. (2) Where a temporary speed limit is fixed in accordance with subsection (1) on any road, a person shall not drive a vehicle on that road at a speed in excess of that speed limit. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 11 Closure of roads VerDate:30/06/1997 (1) The Commissioner or the Director may direct an operator to close either totally or partially any road within the Area to the public whenever a closure appears to be reasonably necessary. (2) The operator shall comply with any direction under subsection (1) and any subsequent direction to re-open the closed road. (3) The operator shall not re-open any road closed under subsection (1)- (a) without the prior consent of; or (b) unless directed to do so by, the Commissioner or the Director. (4) Subject to subsection (5), an operator shall not close, either totally or partially, a road within the Area to the public without the prior permission of the Commissioner or the Director. (5) An operator may close to the public, either totally or partially, and at any time and for a period not exceeding 3 days- (a) any road (including a bridge) within the Area for any one or more of the following reasons- (i) the occurrence of an emergency or accident, including fire, traffic accident, vehicle breakdown or equipment failure; (ii) the safety of persons and vehicles within the Area; (iii) the need for any emergency works to be carried out; and (b) any bridge within the Area, for all vehicles or wind susceptible vehicles only, where he considers that there is or likely to be danger due to inclement weather. (6) Where an operator closes either totally or partially any road or bridge under subsection (5)(a) or (b) he shall notify the Commissioner and the Director as soon as practicable after the closure. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 12 General restrictions VerDate:30/06/1997 Unless complying with a prescribed traffic sign, prescribed light signal or prescribed road marking or with a direction or signal of a police officer or an authorized officer, a person shall not- (a) in any tunnel- (i) drive a vehicle at a speed of less than 25 km per hour except where prevented by another vehicle or at places where a speed of less than 25 km per hour is unavoidable; (ii) drive a vehicle with that vehicle's headlights illuminated at full beam; or (iii) make any U turn with or reverse a vehicle; (b) within the Area- (i) stop a vehicle or permit it to be stationary unless he is- (A) lawfully required to do so; (B) compelled to do so by reason of accident, breakdown, emergency or the presence of other stationary vehicles; (ii) alight from a vehicle except in the event of an emergency or to summon assistance; (iii) change a tyre or wheel on, or refuel or repair a vehicle; (iv) propel a vehicle by pushing that vehicle, whether manually or by any other means; or (v) drive a vehicle on any footway unless complying with any prescribed traffic sign, prescribed light signal or prescribed road marking, or complying with the direction or signal of a police officer or an authorized officer; or (c) enter the Area on foot. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 13 General prohibitions VerDate:30/06/1997 (1) A person shall not drive or cause or permit to be driven, or cause to remain, in a tunnel- (a) a vehicle which is not carrying sufficient fuel in its fuel tank to enable it to be driven through that tunnel; (b) a vehicle carrying animals or poultry not properly controlled or confined, or carrying a load which is not sufficiently covered; (c) a vehicle with a load, or the covering of a load, which is not properly secured so as to prevent any part of the load or that covering from falling off the vehicle or otherwise coming into contact with any part of the tunnel (including any fittings or fixtures); or (d) a vehicle which will or is likely to come into contact with any part of the tunnel (including any fittings or fixtures). (2) A person shall not drive or cause or permit to be driven, or cause to remain, on a road within the Area, a vehicle which will or is likely to endanger any person or property or render any part of the Area unsafe. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 14 Prohibition against vehicles conveying dangerous goods VerDate:24/10/1997 (1) Subject to subsection (2), a person shall not drive or cause or permit to be driven, or cause to remain, in a tunnel- (a) a vehicle carrying any of the goods referred to in Category 1 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg. A); (b) a vehicle carrying any of the goods referred to in Category 2 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg. A) unless there is a quantity specified in relation to such goods in the second column of the Table to regulation 74 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg. B) and the goods carried do not exceed that quantity; (c) without prejudice to paragraph (b), a vehicle carrying any cylinders (as defined in regulation 61 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg. B) used or to be used for the storage of compressed gas referred to in Category 2 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg. A), whether or not such cylinders contain any quantity of such gas; (d) a vehicle carrying any of the goods referred to in Category 5 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg. A) unless there is a quantity specified in relation to such goods in the seventh or eighth column of the Table to regulation 99 of the Dangerous Goods (General) Regulations (Cap 295 sub. leg. B) and the goods carried do not exceed that quantity; or (e) without prejudice to paragraph (d), a vehicle constructed or adapted for the conveyance, or a vehicle carrying a container used or to be used for the storage, of goods referred to in Category 5 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap 295 sub. leg. A), whether or not such vehicle or container contains any quantity of such goods. (2) Despite subsection (1), nothing in this Regulation prohibits the conveyance in any tunnel- (a) of fuel which is being carried in the fuel tank of a vehicle for the purpose only of the propulsion of the vehicle; (L.N. 488 of 1997) (aa) in the case of a vehicle carrying in its fuel tank petroleum spirit for the purpose only of its propulsion, by the vehicle of petroleum spirit, up to a maximum of 20 litres in securely closed cans, which is being carried on the vehicle for such purpose; or (L.N. 488 of 1997) (b) of petroleum spirit which is being carried in a vehicle for the purposes of replenishing refueling facilities for vehicles employed on duty in the Area. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 14 Prohibition against vehicles conveying dangerous goods VerDate:30/06/1997 (1) Subject to subsection (2), a person shall not drive or cause or permit to be driven, or cause to remain, in a tunnel- (a) a vehicle carrying any of the goods referred to in Category 1 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap. 295 sub. leg.); (b) a vehicle carrying any of the goods referred to in Category 2 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap. 295 sub. leg.) unless there is a quantity specified in relation to such goods in the second column of the Table to regulation 74 of the Dangerous Goods (General) Regulations (Cap. 295 sub. leg.) and the goods carried do not exceed that quantity; (c) without prejudice to paragraph (b), a vehicle carrying any cylinders (as defined in regulation 61 of the Dangerous Goods (General) Regulations (Cap. 295 sub. leg.) used or to be used for the storage of compressed gas referred to in Category 2 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap. 295 sub. leg.), whether or not such cylinders contain any quantity of such gas; (d) a vehicle carrying any of the goods referred to in Category 5 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap. 295 sub. leg.) unless there is a quantity specified in relation to such goods in the seventh or eighth column of the Table to regulation 99 of the Dangerous Goods (General) Regulations (Cap. 295 sub. leg.) and the goods carried do not exceed that quantity; or (e) without prejudice to paragraph (d), a vehicle constructed or adapted for the conveyance, or a vehicle carrying a container used or to be used for the storage, of goods referred to in Category 5 of the Schedule to the Dangerous Goods (Application and Exemption) Regulations (Cap. 295 sub. leg.), whether or not such vehicle or container contains any quantity of such goods. (2) Despite subsection (1), nothing in this Regulation prohibits the conveyance in any tunnel- (a) of petroleum spirit which is being carried in a vehicle for the purposes only of the propulsion of the vehicle or of petroleum spirit, up to a maximum of 20 litres in securely closed cans, which is being carried on a vehicle for such use; or (b) of petroleum spirit which is being carried in a vehicle for the purposes of replenishing refueling facilities for vehicles employed on duty in the Area. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 15 Traffic confined to nearside lane in tunnels VerDate:30/06/1997 A person shall not drive- (a) a bus; (b) a goods vehicle of a permitted gross vehicle weight exceeding 5.5 tonnes; (c) a vehicle towing another vehicle; or (d) a vehicle in respect of which a permit is required under section 22, other than in the nearside lane of the tunnel, unless he is directed or signalled to do otherwise by an authorized officer. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 16 Road works within the Area VerDate:01/04/2004 (1) The Director may, on application made in writing and containing such particulars as he may require for the purposes of this section, issue a road works permit to authorize the applicant to carry out any road works within the Area. (2) The Director may- (a) erect, display or place and maintain, or direct an operator or his agent to erect, display or place and maintain traffic signs, light signals, road markings or lanterns of such size, colour and type as he considers appropriate for the purpose of lighting, marking, and guarding road works; and (b) determine fees (including reasonable administrative charges) ("lighting and guarding fees") payable in respect thereof. (3) A person responsible for any road works under a permit issued under subsection (1) shall pay to the Director or the operator, as may be appropriate, the lighting and guarding fees determined for the time being. (4) The lighting and guarding fees may be collected by- (a) the Director, in a manner determined by him, where they are payable to him; (b) an operator, in a manner determined by him, where they are payable to him. (5) For the avoidance of doubt it is stated that a person who carries out road works under a permit issued under this section or a person referred to in section 17(2) is not required to obtain an excavation permit under section 10A or 10D, or an emergency excavation permit under section 10C of the Land (Miscellaneous Provisions) Ordinance (Cap 28) or a permit under Part IV of the Road Traffic (Expressway) Regulations (Cap 374 sub. leg. Q). (Amended 29 of 1998 s. 104; 17 of 2003 s. 16) TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 16 Road works within the Area VerDate:01/07/1997 Amendments retroactively made-see 29 of 1998 s. 104 (1) The Director may, on application made in writing and containing such particulars as he may require for the purposes of this section, issue a road works permit to authorize the applicant to carry out any road works within the Area. (2) The Director may- (a) erect, display or place and maintain, or direct an operator or his agent to erect, display or place and maintain traffic signs, light signals, road markings or lanterns of such size, colour and type as he considers appropriate for the purpose of lighting, marking, and guarding road works; and (b) determine fees (including reasonable administrative charges) ("lighting and guarding fees") payable in respect thereof. (3) A person responsible for any road works under a permit issued under subsection (1) shall pay to the Director or the operator, as may be appropriate, the lighting and guarding fees determined for the time being. (4) The lighting and guarding fees may be collected by- (a) the Director, in a manner determined by him, where they are payable to him; (b) an operator, in a manner determined by him, where they are payable to him. (5) For the avoidance of doubt it is stated that a person who carries out road works under a permit issued under this section or a person referred to in section 17(2) is not required to obtain an excavation permit under section 8 of the Land (Miscellaneous Provisions) Ordinance (Cap 28) or a permit under Part IV of the Road Traffic (Expressway) Regulations (Cap 374 sub. leg.). (Amended 29 of 1998 s. 104) TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 16 Road works within the Area VerDate:30/06/1997 (1) The Director may, on application made in writing and containing such particulars as he may require for the purposes of this section, issue a road works permit to authorize the applicant to carry out any road works within the Area. (2) The Director may- (a) erect, display or place and maintain, or direct an operator or his agent to erect, display or place and maintain traffic signs, light signals, road markings or lanterns of such size, colour and type as he considers appropriate for the purpose of lighting, marking, and guarding road works; and (b) determine fees (including reasonable administrative charges) ("lighting and guarding fees") payable in respect thereof. (3) A person responsible for any road works under a permit issued under subsection (1) shall pay to the Director or the operator, as may be appropriate, the lighting and guarding fees determined for the time being. (4) The lighting and guarding fees may be collected by- (a) the Director, in a manner determined by him, where they are payable to him; (b) an operator, in a manner determined by him, where they are payable to him. (5) For the avoidance of doubt it is stated that a person who carries out road works under a permit issued under this section or a person referred to in section 17(2) is not required to obtain an excavation permit under section 8 of the Crown Land Ordinance (Cap 28) or a permit under Part IV of the Road Traffic (Expressway) Regulations (Cap 374 sub. leg.). TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 17 Persons and vehicles in connection with expressway works VerDate:30/06/1997 (1) Subject to subsection (2), a person who carries out road works on an expressway within the Area- (a) shall comply, in addition to the conditions specified in the permit issued under section 16, with the conditions specified in Schedule 3 to the Expressway Regulation; and (b) shall not use, in connection with the road works, a vehicle other than a vehicle which complies with the conditions specified in that Schedule. (2) A person who is authorized by the Director to carry out road works without a permit referred to in section 16, on an expressway within the Area- (a) shall comply with the conditions specified in Schedule 4 to the Expressway Regulation; and (b) shall not use, in connection with the road works, a vehicle other than a vehicle which complies with the conditions specified in that Schedule, when carrying out the road works. (3) The Director, the Commissioner or the Commissioner of Police may exempt any person or vehicle referred to in subsection (1) from the conditions specified in Schedule 3 to the Expressway Regulation. (4) In this section- "expressway" (快速公路) has the same meaning as in the Expressway Regulation; "Expressway Regulation" (快速公路規例) means the Road Traffic (Expressway) Regulations (Cap 374. sub. leg.). "expressway" (快速公路) "Expressway Regulation" (快速公路規例) TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 18 Display of road works permit VerDate:30/06/1997 (1) Subject to subsection (2), where a road works permit has been issued under section 16, the person responsible for carrying out the road works shall display the road works permit or a copy of that permit in some conspicuous place at, or in the vicinity of, those road works. (2) Subsection (1) does not apply where the road works are being carried out from, or by means of, a vehicle, but, in such a case, the driver of the vehicle shall have with him the road works permit or a copy of that permit and shall immediately produce it for inspection if so requested by the Commissioner, the Director, an authorized officer or a police officer. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 19 Tolls-miscellaneous provisions VerDate:30/06/1997 PART III TOLLS, PERMITS AND EXEMPTIONS (1) If a person pays the toll by tendering one or more toll tickets and the amount paid exceeds the appropriate toll, he is not entitled to a refund or to have the excess returned to him, by cash or otherwise, whether at the time of payment or subsequently. (2) If a person tenders an amount in excess of the appropriate toll at a toll booth displaying the traffic sign shown as Figure No. 13 in Schedule 1, he is not entitled to have the excess returned to him, whether at the time of payment or subsequently. (3) The Commissioner, or an operator with the approval of the Commissioner, may specify conditions in respect of the sale and use of the toll tickets. (4) The Commissioner may by approval in writing allow the use of the Lantau Link without the payment of the appropriate toll by Government vehicles, vehicles used by disabled drivers and vehicles used by operators. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 20 Automatic toll collection facilities VerDate:30/06/1997 (1) The Commissioner may install or permit the installation of- (a) an automatic toll collection facility at any toll booth, for the purpose of collecting tolls for the use of the Lantau Link; and (b) any ancillary facility. (2) The Commissioner, or an operator with the approval of the Commissioner, may, by displaying the traffic sign shown as Figure No. 10 in Schedule 1 at a toll booth referred to in subsection (1)(a), designate the toll booth as an autotoll booth. (3) The Commissioner or under the terms of a management agreement, an operator, may display or permit to be displayed at an autotoll booth the traffic signals shown as Figure Nos. 11 and 12 in Schedule 1. (4) The Commissioner, an operator or an agent may issue an electronic toll pass to a person who opens an account with the Commissioner, operator or agent, as the case may be, for the payment of the appropriate toll at an autotoll booth for the use of the Lantau Link. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 21 Prohibition against interference with or falsification of electronic toll passes VerDate:30/06/1997 (1) Except when authorized by the Commissioner, a person shall not do anything to or with an electronic toll pass whereby- (a) the coded data thereon is erased wholly or in part or is otherwise altered or interfered with; or (b) the electronic toll pass is otherwise damaged or destroyed. (2) A person shall not use or attempt to use for the purpose of paying the appropriate toll- (a) an electronic toll pass which has been altered, damaged or interfered with; (b) an electronic toll pass the account in respect of which is not opened in his name or which has been obtained by fraud or deception; or (c) any material or thing purported to be or passed off as an electronic toll pass. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 22 Vehicles requiring permits and escort VerDate:30/06/1997 (1) A person shall not, within the Area, drive a vehicle- (a) the width (including any load and any equipment attached to the vehicle) of which exceeds 2.5 m; (b) the length (including any load and any equipment attached to the vehicle) of which exceeds 12 m; (c) the height (including any load and any equipment attached to the vehicle) of which exceeds 4.6 m; (d) that is drawing a trailer and the combined length of the vehicle and trailer (including drawbar and any load) exceeds 16 m; (e) that requires a movement permit under regulation 53(1) of the Road Traffic (Registration and Licensing of Vehicles) Regulations (Cap 374 sub. leg.); or (f) that is so loaded that its gross vehicle weight exceeds the permitted maximum gross vehicle weight or if applicable, the permitted maximum gross combined weight, assigned or determined in respect of that vehicle under the Second Schedule to the Road Traffic (Construction and Maintenance of Vehicles) Regulations (Cap 374 sub. leg.), other than in accordance with the conditions of a permit issued by the Commissioner or by an operator, under the terms of a management agreement, for the passage of that vehicle. (2) A person shall not drive a vehicle on any road within the Area which is closed unless prior permission has been obtained- (a) from the Commissioner; (b) from the Director; or (c) from an operator, under the terms of a management agreement, as may be appropriate in the circumstances. (3) A permit issued under subsection (1) is subject to such conditions as the Commissioner may specify. (4) Without prejudice to the generality of subsection (3), the Commissioner or, under the terms of a management agreement, an operator, may require that a vehicle which is the subject of a permit issued under subsection (1) or a vehicle in respect of which permission has been given under subsection (2), be accompanied by an escort vehicle, provided by the Commissioner or the operator, as the case may be, when passing through the Area. (5) The driver of a vehicle in respect of which a permit has been issued under this section shall immediately produce the permit for inspection by a police officer or an authorized officer when called upon to do so. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 23 Exemptions VerDate:30/06/1997 This Regulation does not apply to the following persons to the extent and in the circumstances described in relation to the person- (a) sections 7(2), 9, 10(2), 12(a), (b)(i), (ii) and (v) and (c), 14 and 15 do not apply to the driver or owner of a vehicle of the Fire Services Department, an ambulance, a police vehicle, a customs and excise vehicle or a vehicle used for defence purposes (including civil defence purposes) where the vehicle is being used in the course of urgent duties; (b) sections 7(2), 9, 10(2) and 12(a), (b)(i), (ii) and (v) and (c) do not apply to- (i) a person engaged in the maintenance, repair, cleaning, clearance, survey, inspection, alteration or improvement of a road within the Area; (ii) a person engaged in the erection, laying, placing, maintenance, testing, alteration, repair or removal of any structure, works or apparatus in, on, under or over any part of a road within the Area; (iii) a person engaged in any activity which is the subject of a permit issued by the Commissioner or the Director; (c) sections 9 and 10(2) do not apply to- (i) a person engaged in the avoidance or prevention of an accident or obtaining or giving assistance required as a result of an accident or emergency; (ii) a person engaged in providing the necessary assistance as a result of a vehicle stopping on any road within the Area by reason of a breakdown, other defect or as a result of any other circumstances outside the control of the driver; (d) sections 7(2), 9, 10(2), 12(a), (b)(i), (ii) and (v) and (c), 14 and 15 do not apply to a person who is complying with any direction given by a police officer or an authorized officer on duty in the Area; and (e) sections 7(2), 9, 10(2), 12 and 15 do not apply to- (i) a public officer or an authorized officer on duty in the Area; or (ii) the following persons engaged in road works in the Area- (A) an agent or subcontractor appointed by the Director; and (B) maintenance staff, an agent or subcontractor appointed by an operator. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 24 Miscellaneous offences VerDate:30/06/1997 PART IV OFFENCES A person shall not- (a) paint or affix any poster, placard, bill, or other matter except with the permission of the Commissioner; (b) tamper with any installation, structure, building, facility, utility, equipment, appliance, vehicle or other article; (c) enter or remain in any building or other facility without approval or permission of a public officer who is the subject of a delegation under section 9 of the Ordinance or any other person employed by an operator who is authorized by the operator to give such approval or permission, within the Area. TSING MA CONTROL AREA (GENERAL) REGULATION - SECT 25 Offences and penalties VerDate:30/06/1997 Any person who- (a) contravenes sections 7(2), 9, 10(2), 12, 13, 14(1) or 15; (b) carries out road works, without a permit under section 16(1), within the Area or is in breach of a condition in a permit issued under that section; (c) contravenes section 17(1), 18 or 21; (d) contravenes section 22(1) or (2), fails to comply with a requirement made under section 22(4) or fails to comply with section 22(5); or (e) contravenes section 24, commits an offence and is liable to a fine at level 2 and to imprisonment for 6 months. FIGURE NO. 6 DANGEROUS GOODS PROHIBITED THIS SIGN INDICATES THAT VEHICLES CARRYING DANGEROUS GOODS OF PARTICULAR CATEGORIES ARE PROHIBITED FROM PASSING BEYOND THE SIGN. IT MAY BE USED IN CONJUNCTION WITH THE SIGN IN FIGURE NO. 7. FIGURE NO. 7 THIS SIGN WHEN USED IN CONJUNCTION WITH THE SIGN IN FIGURE NO. 6 INDICATES THE CATEGORY OR CATEGORIES OF DANGEROUS GOODS REFERRED TO IN THAT FIGURE. FIGURE NO. 8 STOP, PAY TOLL SIGN THIS SIGN INDICATES THAT ALL DRIVERS MUST STOP AND PAY THE APPROPRIATE TOLL APPLICABLE TO THE VEHICLE. FIGURE NO. 9 KEEP IN LANE THIS SIGN INDICATES THAT VEHICLES MUST KEEP IN THEIR LANES. FIGURE NO. 10 LANE SIGN (AUTOTOLL ONLY) THIS SIGN IS DISPLAYED IMMEDIATELY ABOVE THE TRAFFIC LANE WHICH IS DEDICATED FOR USE OF AN AUTOMATIC TOLL COLLECTION FACILITY. IT INDICATES THAT ONLY THOSE VEHICLES WITH VALID ELECTRONIC PASSES AND IN RESPECT OF WHICH AN ACCOUNT HAS BEEN OPENED WITH THE COMMISSIONER, THE OPERATOR OR AGENT SHALL PROCEED IN THE SAID TRAFFIC LANE. FIGURE NO. 11 AUTOTOLL PAYMENT SIGNAL THIS SIGNAL IS PLACED IN A VERTICAL POSITION AT THE SIDE OF A TRAFFIC LANE DEDICATED FOR USE OF AN AUTOMATIC TOLL COLLECTION FACILITY. IT MAY BE USED IN CONJUNCTION WITH THE SIGNAL IN FIGURE NO. 12. THE SIGNIFICANCE OF THE SIGNAL SHALL BE AS FOLLOWS- (a) THE DISPLAY OF A RED SIGNAL INDICATES THAT THE APPROPRIATE TOLL PAYMENT HAS NOT BEEN MADE AND THAT THE ACCOUNT BALANCE WITH THE COMMISSIONER, THE OPERATOR OR AGENT IN RESPECT OF THE ELECTRONIC PASS IS NIL; (b) THE DISPLAY OF A GREEN SIGNAL INDICATED THAT THE APPROPRIATE TOLL PAYMENT HAS BEEN MADE. FIGURE NO. 12 AUTOTOLL ACCOUNT BALANCE SIGNAL THIS SIGNAL IS PLACED IN A VERTICAL POSITION AT THE SIDE OF A TRAFFIC LANE DEDICATED FOR USE OF AN AUTOMATIC TOLL COLLECTION FACILITY. IT MAY BE USED IN CONJUNCTION WITH THE SIGNAL IN FIGURE NO. 11. THE SIGNIFICANCE OF THE SIGNAL SHALL BE AS FOLLOWS- (a) THE DISPLAY OF THE RED DOLLAR SIGN INDICATES THAT THE ACCOUNT BALANCE WITH THE COMMISSIONER, THE OPERATOR OR AGENT IN RESPECT OF THE ELECTRONIC PASS IS NIL; (b) THE DISPLAY OF THE AMBER DOLLAR SIGN INDICATES THAT THE ACCOUNT BALANCE WITH THE COMMISSIONER, THE OPERATOR OR AGENT IN RESPECT OF THE ELECTRONIC PASS IS LESS THAN THE AMOUNT SPECIFIED BY THE COMMISSIONER, THE OPERATOR OR AGENT. FIGURE NO. 13 NO CHANGE TOLL SIGN WHEN THIS SIGN IS DISPLAYED AT A TOLL BOOTH IT INDICATES THAT THE TOLL BOOTH IS FOR USE ONLY BY DRIVERS PAYING THE APPROPRIATE TOLL AND REQUIRING NO CHANGE TO BE GIVEN. FIGURE NO. 14 LANE SIGNAL THE SIGNAL MAY IN A TUNNEL AREA BE PLACED IN A VERTICAL OR HORIZONTAL POSITION ABOVE OR AT THE SIDE OF A TRAFFIC LANE FOR THE CONTROL OF THAT TRAFFIC PROCEEDING ALONG THE TRAFFIC LANE OVER OR AT THE SIDE OF AND IN RELATION TO WHICH THE SIGNALS HAVE BEEN PLACED, PROVIDED THAT WHEN THE SIGNAL IS PLACED ABOVE THE TRAFFIC LANE THE GREEN ARROW SHALL POINT DOWNWARDS. THE SIGNIFICANCE OF THE SIGNAL SHALL BE AS FOLLOWS- (a) WHEN A GREEN ARROW IS DISPLAYED VEHICULAR TRAFFIC PROCEEDING IN THE TRAFFIC LANE ABOVE OR AT THE SIDE OF AND IN RELATION TO WHICH IT IS DISPLAYED MAY PROCEED ALONG THAT LANE; (b) WHEN A STEADY OR INTERMITTENT AMBER LIGHT IS DISPLAYED VEHICULAR TRAFFIC PROCEEDING IN THE TRAFFIC LANE ABOVE OR AT THE SIDE OF AND IN RELATION TO WHICH IT IS DISPLAYED SHALL PROCEED ALONG THAT LANE WITH CAUTION AND BE PREPARED TO STOP, PROVIDED THAT THE AMBER LIGHT MAY BE OMITTED FROM ANY SIGNAL INSTALLATION WHEN THE SIGNAL SHALL CONSIST OF A LIGHT CAPABLE OF SHOWING A RED CROSS AND A LIGHT CAPABLE OF SHOWING A GREEN ARROW; (c) WHEN A RED CROSS IS DISPLAYED VEHICULAR TRAFFIC PROCEEDING IN THE TRAFFIC LANE ABOVE OR AT THE SIDE OF AND IN RELATION TO WHICH IT IS DISPLAYED SHALL NOT PROCEED BENEATH OR BEYOND OR PAST THE RED CROSS. THE SIGNAL MAY BE USED AT TOLL BOOTHS. FIGURE NO. 15 PARKING PLACE FOR MOTOR CYCLES THIS SIGN INDICATES THAT WHEN USED IN CONJUNCTION WITH THE ROAD MARKING IN FIGURE NO. 2 IN SCHEDULE 2, THE PARKING PLACE IS FOR MOTOR CYCLES ONLY. FIGURE NO. 16 PARKING FOR BUSES THIS SIGN INDICATES THAT WHEN USED IN CONJUNCTION WITH THE ROAD MARKING IN FIGURE NO. 1 OR 3 OR BOTH IN SCHEDULE 2, THE PARKING PLACE OR PARKING SPACE IS FOR BUSES ONLY. FIGURE NO. 17 PARKING FOR VEHICLES OTHER THAN MEDIUM AND HEAVY GOODS VEHICLES, BUSES, MOTOR CYCLES AND PEDAL CYCLES THIS SIGN INDICATES THAT WHEN USED IN CONJUNCTION WITH THE ROAD MARKING IN FIGURE NO. 1 OR 3 OR BOTH IN SCHEDULE 2, THE PARKING PLACE OR PARKING SPACE IS FOR VEHICLES OTHER THAN MEDIUM AND HEAVY GOODS VEHICLES, BUSES, MOTOR CYCLES AND PEDAL CYCLES. FIGURE NO. 18 OTHER DANGER AHEAD THIS SIGN WARNS OF POTENTIAL DANGER AHEAD. FIGURE NO. 19 LANE USE SIGNAL THIS SIGN WHEN DISPLAYED CONVEYS TO VEHICULAR TRAFFIC PROCEEDING IN THE TRAFFIC LANE ABOVE AND IN RELATION TO WHICH IT IS DISPLAYED THAT TRAFFIC MAY PROCEED OR CONTINUE TO DO SO IN THE SAID LANE BENEATH OR BEYOND THE SAID ARROW AND IN THE DIRECTION OPPOSITE TO THAT IN WHICH THE ARROW FACES. IT MAY ALSO BE USED AT A TOLL BOOTH TO INDICATE THAT VEHICLES MAY PROCEED IN THAT LANE. FIGURE NO. 20 PROCEED LEFT OR KEEP LEFT THE DIRECTION OF THE ARROW MAY BE REVERSED TO GIVE- PROCEED RIGHT OR KEEP RIGHT THIS SIGN INDICATES THAT VEHICLES MUST PROCEED TO THE LEFT-HAND LANE, OR TO THE RIGHT-HAND LANE, IF THE DIRECTION OF THE ARROW IS REVERSED. FIGURE NO. 21 LANE USE SIGNAL THIS SIGN WHEN DISPLAYED CONVEYS TO VEHICULAR TRAFFIC PROCEEDING IN THE TRAFFIC LANE ABOVE AND IN RELATION TO WHICH IT IS DISPLAYED THE PROHIBITION THAT SUCH TRAFFIC SHALL NOT PROCEED BENEATH OR BEYOND THE RED CROSS IN THE SAID TRAFFIC LANE IN THE DIRECTION OPPOSITE TO THAT IN WHICH THE RED CROSS FACES. IT MAY ALSO BE USED AT A TOLL BOOTH TO INDICATE THAT VEHICLES MAY NOT PROCEED IN THAT LANE. FIGURE NO. 22 SPEED LIMIT THIS SIGN INDICATES THAT A SPEED LIMIT OF 50 KM PER HOUR IS IMPOSED ON THE SECTION OF THE ROAD IMMEDIATELY FOLLOWING THE SIGN. THE NUMERALS IN THE SIGN MAY BE ALTERED TO SUIT THE SPEED LIMIT IN FORCE. FIGURE NO. 23 DIVERSION TO ANOTHER CARRIAGEWAY TO RIGHT AHEAD THE SYMBOL MAY BE REVERSED TO GIVE- DIVERSION TO ANOTHER CARRIAGEWAY TO LEFT AHEAD THIS SIGN WILL BE USED TO DIVERT TRAFFIC FROM ONE CARRIAGEWAY OF A DUAL CARRIAGEWAY ROAD TO THE OTHER CARRIAGEWAY.
