AMUSEMENT RIDES (SAFETY) (OPERATION AND MAINTENANCE) REGULATION - SECT 8

PART IV

OPERATION OF AMUSEMENT RIDES

(1) The owner of an amusement ride shall not operate the ride-

   (a)  in the case of an existing amusement ride, on or after the expiration
        of 3 months immediately following the appointed day;

   (b)  in any other case, at any time, unless he has at all times in his
        employ-

        (i)    a competent person in respect of the ride; and

        (ii)   such number of operators, to perform such duties, as have been
               approved by the Director.

(2) The Director may, if in his opinion the safe operation of an amusement
ride so requires, vary his approval given under subsection

(1)(ii) either as regards the number of operators to be employed on the ride
or as regards their duties.

(3) For the purpose of subsection (1), the owner of an amusement ride shall,
as soon as is reasonably practicable, submit to the Director a notice in
writing giving-

   (a)  the name of the competent person in respect of the ride; and

   (b)  the proposed number of operators to be employed in the operation of
        the ride and details of the proposed duties and hours of work of each
        operator.

(4) When an amusement ride is in operation, the competent person in respect of
the ride shall-

   (a)  ensure that there is on duty such number of operators as the Director
        has approved under subsection (1)(ii); and

   (b)  appoint 1 of those operators to be a chief operator (or, if the
        Director has approved only 1 operator under subsection (1)(ii), that
        operator) and ensure that the operator so appointed is informed that
        he-

        (i)    has been so appointed; and

        (ii)   is required to perform the duties of a chief operator under
               this Regulation.

(5) The owner of an amusement ride shall not employ 2 or more
competent persons unless-

   (a)  without prejudice to the generality of section 5(5), he specifies, by
        notice in writing, the duties to be performed under this Regulation by
        each competent person; and

   (b)  no duty so specified in the case of one competent person is the same
        as a duty so specified in the case of another competent person.

(6) The owner of an amusement ride may, by notice in writing, vary a notice
made by him pursuant to subsection (5)(a) if, but only if, he does not thereby
contravene subsection (5)(b).

(7) The owner of an amusement ride shall submit to the Director a copy of each
notice made by him pursuant to subsection (5)(a) or (6)-

   (a)  in the case of a notice made pursuant to subsection (5)(a), at the
        same time as the notice made by him pursuant to subsection (3)(a) is
        submitted to the Director in respect of the competent person to which
        the notice made pursuant to subsection (5)(a) relates;

   (b)  in the case of a notice made pursuant to subsection (6), not later
        than 14 days after the notice has been made.

(8) For the avoidance of doubt, it is hereby declared that the appointment of
an operator as a chief operator shall be without prejudice to any duty
required to be performed by him under this Regulation in his capacity as an
operator. (Enacted 1994)
