AMUSEMENT RIDES (SAFETY) (OPERATION AND MAINTENANCE) REGULATION - SECT 5
Grounds for approval of surveyor, competent person or qualified person
(1) Where, on application for the approval of a person as a surveyor, the
Director is satisfied that-
(a) the person-
(i) is a registered professional engineer, within the meaning of
the Engineers Registration Ordinance ( Cap 409), who is
qualified as a mechanical, marine, electrical or electronic
engineer; and
(ii) has not less than 3 years relevant practical experience; or
(b) by reason of the person's knowledge and relevant practical experience,
he is competent to carry out the examinations required by this
Regulation to be carried out by a surveyor, the Director shall
approved that person as a surveyor.
(2) Where, on application for the approval of a person as a competent person,
the Director is satisfied that-
(a) the person has-
(i) a higher certificate or higher diploma in mechanical, marine,
electrical or electronic engineering from the Hong Kong
Polytechnic or a technical institute; and
(ii) not less than 5 years relevant practical experience; or
(b) by reason of the person's knowledge and relevant practical experience,
he is competent to perform the duties required by this Regulation to
be performed by a competent person, the Director shall approve that
person as competent person.
(3) Where, on application for the approval of a person as a qualified person,
the Director is satisfied that-
(a) the person has-
(i) a higher certificate or higher diploma in mechanical, marine,
electrical or electronic engineering from the Hong Kong
Polytechnic or a technical institute; and
(ii) not less than 3 years relevant practical experience; or
(b) by reason of the person's knowledge and relevant practical experience,
he is competent to carry out the examinations required by this
Regulation to be carried out by a qualified person, the Director shall
approve that person as a qualified person.
(4) Where the Director approves a person as a surveyor, competent person or
qualified person, he shall issue that person with a certificate of approval,
which certificate may limit the duties which that person may perform and be
subject to such conditions as the Director thinks fit.
(5) A surveyor, competent person or qualified person who has been issued with
a limited certificate of approval under subsection (4) shall not perform any
duties as a surveyor, competent person or qualified person, as the case may
be, for which he has not been approved.
(6) The Director may, on application in the prescribed form made to him by the
holder of a limited certificate of approval issued under subsection (4) and on
payment of the prescribed fee, amend the certificate by-
(a) altering the duties which the holder may perform as a surveyor,
competent person or qualified person, as the case may be;
(b) varying the conditions to which the holder is subject; or
(c) removing all the limitations and conditions.
(7) The Director, by notice in writing served on the holder of a certificate
of approval issued under subsection (4), revoke the certificate if-
(a) the holder has been convicted of an offence under the Ordinance; or
(b) it appears to the Director that the holder has, in performing his
duties as a surveyor, competent person or qualified person, as the
case may be, been guilty of such negligence or misconduct as to render
the holder unfit to be a surveyor, competent person or
qualified person, as the case may be.
(8) Where the holder of a certificate of approval issued under subsection (4)
is served with a notice under subsection (7) revoking the certificate, he
shall-
(a) thereupon cease to be approved as a surveyor, competent person or
qualified person, as the case may be; and
(b) surrender that certificate-
(i) to the Director; and
(ii) not later than 14 days after the service of that notice.
