AMUSEMENT RIDES (SAFETY) (OPERATION AND MAINTENANCE) REGULATION - SECT 34

Offences and penalties relating to surveyors and others

(1) Any surveyor, competent person, qualified person or chief  operator who-

   (a)  delivers to-

        (i)    the Director; or

        (ii)   the owner of an amusement ride, any report; or

   (b)  makes any entry in a record, which is to his knowledge false in a
        material particular or which he does not believe to be true commits an
        offence and is liable on conviction to a fine of $10000 and to
        imprisonment for 6 months.

(2) Where it is proved to the satisfaction of a magistrate or court that an
offence referred to in subsection (1) (except any such offence which relates
to paragraph (a)(ii) of that subsection) has been committed by any surveyor,
competent person, qualified person or chief operator, the owner of the
amusement ride who appointed the surveyor or qualified  person, or employed
the competent person or chief operator, as the case may be, shall also be
liable for such offence and to the penalty provided for the offence unless he
satisfies the magistrate or court that-

   (a)  the offence was committed without his knowledge or consent; and

   (b)  he had exercised all due diligence to prevent the commission of the
        offence as the magistrate or court considers reasonable in the
        circumstances. (Enacted 1994)
