AMUSEMENT RIDES (SAFETY) (OPERATION AND MAINTENANCE) REGULATION - SECT 33

Offences and penalties relating to owners

(1) Any owner of an amusement ride who-

   (a)  contravenes section 6(1) or (2), 8(1), (3), (5), (6) or (7), 11(1),
        14(1), 15, 18(1) or (3), 20(1), 21(1), (2) or (3), 25(1) or (2) or
        26(a); or

   (b)  fails, without reasonable excuse, to comply with a requirement of the
        Director under section 18(2), 19(1) or 26(b), commits an offence and
        is liable on conviction to the penalty set out in columns 2, 3 and 4
        of Part III of the Schedule opposite the reference to that section in
        column 1 of Part III of the Schedule.

(2) Any owner of a kiddie ride who-

   (a)  contravenes section 27(1), (2) or (3), 28(1), 29(1) or (2)(a) or (b)
        or 30; or

   (b)  fails, without reasonable excuse, to comply with a requirement of the
        Director under section 27(3) or 29(2)(b), commits an offence and is
        liable on conviction to a fine of $5000 and to imprisonment for 6
        months. (Enacted 1994)
