AIR TRANSPORT (LICENSING OF AIR SERVICES) REGULATIONS - REGULATION 30A

Power of Director-General or authorized person to prohibit flight

(Past version on 30/06/1997).

(1) Where it appears to the Director-General of Civil Aviation or an
authorized person that any aircraft is intended or is likely to be flown in
such circumstances that any provision of regulation 3 or 22 would be
contravened in relation to the flight, the Director-General of Civil  Aviation
or an authorized person may-

   (a)  direct the operator or commander of the aircraft that he is not to
        permit the aircraft to make the particular flight or any other flight
        of such description as may be specified in the direction, until the
        direction has been revoked by the Director-General of Civil Aviation
        or by an authorized person; and

   (b)  take such steps as are necessary to detain the aircraft.

(2) For the purposes of paragraph (1), the Director-General of  Civil Aviation
and an authorized person may enter upon and inspect any aircraft.

(3) Any person who, being the operator or commander of an aircraft,
contravenes any direction given to him under paragraph (1)(a) shall be guilty
of an offence and shall be liable on conviction to a fine of $7000 or to
imprisonment for 3 months. (L.N. 140 of 1969; L.N. 326 of 2000)
