TRADE MARKS RULES - RULE 48
Registrar's certificate or approval

(1) Any person wishing to obtain the Registrar's certificate under
section 41(5) or 41A(5) shall file an application on Form TM-No. 17, a
statement of case in duplicate setting out the circumstances and a copy of any
instrument or proposed instrument effecting the assignment or transmission in
question.
(2) The Registrar may call for any evidence or further information that he may
consider necessary, and the statement of case shall if required be amended to
include all the relevant circumstances or verified by statutory declaration;
and if the statement of case is amended, 2 fair copies in its final form shall
be filed.
(3) After hearing the applicant (if so required) and any other person whom he
may consider to be interested in the transfer, the Registrar shall consider
the matter and issue a certificate thereon and shall attach a copy of the
statement of case in its final form to the certificate and affix his seal
thereto. (Enacted 1992)
