TRADE MARKS RULES - RULE 43

Case accompanying application

(1) Where an applicant under rule 40 does not claim under any document or
instrument which is capable in itself of furnishing proof of his title, he
shall, unless the Registrar otherwise directs, file with the application a
statement of case setting forth the full particulars of the facts upon which
his claim to be proprietor of the mark in question is based and showing that
it has been assigned or transmitted to him.

(2) If the Registrar so requires the case shall be verified by statutory
declaration. (Enacted 1992)
