BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (FUNCTIONAL CONSTITUENCIES AND ELECTION COMMITTEE CONSTITUENCY) REGULATION - SECT 78

Reporting of irregularities

(1) Where the presiding officer, returning officer or the Chief Electoral
Officer is of the opinion that any irregularity has occurred in relation to an
election or a by-election, a poll or count, he shall make a report in writing
to the Commission as regards such occurrence, as soon as practicable, and in
any case within 30 days beginning on the polling day as regards that election
or by-election.

(2) In the case of the occurrence or likely occurrence of an irregularity
which any officer referred to in subsection (1) considers a material
irregularity, he shall make a report to the Commission forthwith in such
manner as he considers expedient having regard to the circumstances.

(3) Where a report is made under subsection (2) otherwise than in writing, the
officer concerned shall also make a report regarding the relevant occurrence
in writing, in compliance with subsection (1). (Enacted 1995)
