BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (FUNCTIONAL CONSTITUENCIES AND ELECTION COMMITTEE CONSTITUENCY) REGULATION - SECT 73

Declaration of secrecy

(1) Every-

   (a)  returning officer, other officer or person authorized by or under this
        Regulation to attend at a polling station except as an elector; and

   (b)  candidate, counting agent, counting officer or other person

(except the members of the public referred to in section 47(3)) authorized by
or under this Regulation to attend at the conduct of a count, shall before
entering the polling station or the counting commences, as may be applicable,
make a declaration of secrecy in the specified form.

(2) In the case of a returning officer the declaration shall be made in the
presence of a commissioner for oaths, and in the case of any other person, the
declaration may be made in the presence of a commissioner for oaths or
returning officer. (47 of 1997 s. 10)

(3) Every returning officer or other officer or any other person attending at
a polling station or a count, shall maintain and assist in maintaining the
secrecy of the ballot.

(4) Subsection (1) shall not apply to a police officer attending at a polling
station or a counting station. (Enacted 1995)
