BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (FUNCTIONAL CONSTITUENCIES AND ELECTION COMMITTEE CONSTITUENCY) REGULATION - SECT 55
Declaration of result

(1) When the counting of votes and re-counts, if any, are completed and a
result obtained, the returning officer shall declare to be elected a candidate
as provided in section 12A of the Legislative Council (Electoral
Provisions) Ordinance ( Cap. 381).
(2) The returning officer shall prepare a notice of result of the election in
respect of-
(a) the election committee constituency, in Form 4;
(b) any functional constituency, in Form 5.
(3) The returning officer shall cause a copy each of the notices under
subsection (2) to-
(a) be displayed prominently in a place outside the counting station;
(b) be sent to the Chairman of the Commission;
(c) be sent to the Chief Secretary;
(d) be sent to the Chief Electoral Officer; and
(e) be published in the Gazette within 10 days beginning on the date the
result is declared under subsection (1).
(4) The result of an election as declared by the returning officer in a notice
under subsection (2) shall be final and not be questioned in any proceeding
except by an election petition. (Enacted 1995)
