BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (FUNCTIONAL CONSTITUENCIES AND ELECTION COMMITTEE CONSTITUENCY) - SECT 51

Re-count

(1) The returning officer shall make known to the candidates or their
respective election agents or counting agents who are present within the
counting station, the result of the counting of the votes when the count is
completed under section 50(2).

(2) A candidate or the election agent of a candidate, if present when the
counting or a re-counting of the votes in respect of the relevant constituency
is completed, may request the returning officer to cause the counted or
re-counted votes, as the case may be, to be counted again and the
returning officer shall comply with any such request unless in his opinion it
is unreasonably made.

(3) Nothing further shall be done on the completion of a counting or
re-counting of the votes until each candidate present at such completion or
each election agent of a candidate if so present is given a reasonable
opportunity to make the request referred to in subsection (2).

(4) The following shall apply as regards any re-count of the votes in the
election committee constituency-

   (a)  if the count or counts preceding the re-count-

        (i)    were conducted manually,. such re-count shall be conducted in
               the same manner; and

        (ii)   were conducted using an approved programme, such re-count shall
               be conducted in the same manner, unless it is not reasonably
               practicable to do so;

   (b)  in paragraphy (a) "approved programme" (認可程式) has the meaning
        assigned to it by Schedule 3. (Enacted 1995) "approved programme"
        (認可程式)
