BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (FUNCTIONAL CONSTITUENCIES AND ELECTION COMMITTEE CONSTITUENCY) REGULATION - SECT 44

Time and place for the count and the notification thereof

PART IV COUNTING OF VOTES

(1) The returning officer shall give notice in writing to each candidate-

   (a)  of the place or places at which the count as regards the constituency
        concerned is to take place; and

   (b)  the time at which the count will begin, not less than 24 hours in
        advance of the time referred to in paragraph (b).

(2) The time for the purposes of subsection (1)(b) shall be determined by the
returning officer and be a time which is after the close of the poll in all
the polling stations in respect of the constituency concerned.

(3) Where a poll at a polling station is adjourned under section  62 , the
conduct of the count in respect of the other polling stations (if any)
designated in respect of that constituency or those constituencies and at
which the poll has closed, shall stand postponed until such time arrangements
for the purposes of section 49 can be made.

(4) Where a count stands postponed pursuant to subsection (3)-

   (a)  the Chief Electoral Officer shall determine the time (being a time
        after the close of the adjourned poll) for the count to begin and the
        place or places for it to take place in respect of the adjourned poll
        and the other polling stations (if any) in respect of the constituency
        or constituencies concerned; and

   (b)  the returning officer shall give notice to each candidate of such time
        and place or places.

(5) A notice required to be given to a candidate under subsection

(1) or (4) may be given to the election agent or counting agent of the
candidate and any notice so given shall be regarded, for the purposes of the
relevant subsection, as a notice given to the candidate. (Enacted 1995)
