BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (FUNCTIONAL CONSTITUENCIES AND ELECTION COMMITTEE CONSTITUENCY) REGULATION - SECT 35

Procedure for voting

(1) Subject to section 37, an elector after he receives-

   (a)  a ballot paper in respect of a functional constituency or a ballot
        paper each in respect of a functional constituency and a geographical
        constituency in a polling station designated for one or more
        functional constituencies and a geographical constituency, shall
        forthwith proceed into one of the compartments in the polling station
        and there mark his ballot paper or ballot papers, as appropriate, and
        fold it so as to conceal the mark or marks on it and put the ballot
        paper or ballot papers so folded into the ballot box; and

   (b)  a ballot paper in respect of the election committee constituency,
        shall mark it so as to indicate his choice of candidate or candidates,
        conceal the mark or marks on it with the device provided for the
        purpose at the polling station, and subject to subsection (2), put the
        ballot paper into the ballot box.

(2) An elector voting in respect of the election committee constituency may,
before putting the ballot paper into the ballot box, ascertain whether he has
marked the ballot paper correctly, by using the device, if any, provided for
the purpose at the polling station.

(3) An elector shall vote without undue delay and leave the polling station as
soon as he has put the ballot paper into the ballot box.

(4) A person shall not put anything other than a marked ballot paper into the
ballot box or in the case of an elector voting in respect of the election
committee constituency, a marked ballot paper and the device referred to in
subsection (1)(b).

(5) Except where otherwise provided in this Regulation, a person shall not
remove a ballot paper from a polling station. (Enacted 1995)
