BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (FUNCTIONAL CONSTITUENCIES AND ELECTION COMMITTEE CONSTITUENCY) REGULATION - SECT 3

PART II STAGES OF ELECTION PRECEDING A POLL

(1) After a notice for the purposes of section 3(3) of the
Legislative Council (Electoral Provisions) Ordinance ( Cap. 381) is published
in the Gazette, the Chief Electoral Officer shall publish in the Gazette, as
regards-

   (a)  the election committee constituency, a notice which shall-

        (i)    state the number of vacancies in the election committee
               constituency;

        (ii)   state that nomination papers in respect of that constituency
               must be delivered so as to be received by the returning officer
               on a working day during office hours within the period
               specified for the purpose in the notice;

        (iii)  specify an address for the delivery of nomination papers under
               subparagraph (ii) and the address of the place from which the
               specified forms for the purposes of section 6(5) can be
               obtained; and

        (iv)   state the date on which such election is to be held and that
               there will be a poll on that date in respect of that
               constituency unless the number of validly nominated candidates
               does not exceed the number of vacancies in it; and

   (b)  the functional constituencies, a notice which shall-

        (i)    contain the name of each functional constituency and state in
               relation thereto, the number of vacancies in it;

        (ii)   state that nomination papers in respect of a functional
               constituency must be delivered so as to be received by the
               returning officer on a working day during office hours within
               the period specified for the purpose in the notice;

        (iii)  specify an address for the delivery of nomination papers under
               subparagraph (ii) and the address of the place from which the
               specified forms for the purposes of section 6(5) can be
               obtained; and

        (iv)   state the date on which the election in respect of the
               functional constituencies is to be held and that there will be
               a poll on that date in respect of every functional constituency
               other than a constituency in respect of which the number of
               validly nominated candidates does not exceed the number of
               vacancies in that constituency.

(2) The period for the purposes of subsection (1)(a)(ii) or (b)(ii) shall, in
each case-

   (a)  be determined by the Chief Electoral Officer;

   (b)  be a period beginning not earlier than the date of the publication of
        the relevant notice under subsection (1) and not less than 14 days or
        more than 21 days in duration; and

   (c)  be a period ending not less than 28 days and not more than 42 days
        before the date on which the relevant election is to be held.

(3) Subject to this section, a notice under subsection (1) shall be in the
specified form. (Enacted 1995)
