BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (FUNCTIONAL CONSTITUENCIES AND ELECTION COMMITTEE CONSTITUENCY) REGULATION - SECT 13

Holding of poll or declaration of election without poll

Where, after-

   (a)  the nomination period has expired;

   (b)  the returning officer has made a decision in respect of each candidate
        under section 9(1); and

   (c)  any withdrawals of candidature, in respect of any constituency-

        (i)    the number of validly nominated candidates is more than the
               number of vacancies in that constituency, a poll shall be held
               in respect of that constituency in accordance with Part III; or

        (ii)   the number of validly nominated candidates is less than or
               equal to the number of vacancies, those candidates shall be
               declared elected in the notice of nominations published in
               respect of that constituency under section 12. (Enacted 1995)
