BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 71
Declaration of secrecy

(1) Every-
(a) returning officer, other officer or person authorized to attend at a
polling station except as an elector; and
(b) candidate, counting agent, counting officer or other person
(except the members of the public referred to in section 45(3)) authorized to
attend at the conduct of a count, (L.N. 221 of 1995) shall before entering the
polling station or the counting commences, as may be applicable, make a
declaration of secrecy in the specified form.
(2) In the case of a returning officer the declaration shall be made in the
presence of a commissioner for oaths, and in the case of any other person, the
declaration may be made in the presence of a commissioner for oaths or
returning officer. (47 of 1997 s. 10)
(3) Every returning officer or other officer or any other person attending at
a polling station or a count, shall maintain and assist in maintaining the
secrecy of the ballot. (L.N. 221 of 1995)
(4) Subsection (1) shall not apply to a police officer attending at a polling
station or a counting station. (Enacted 1994)
