BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 6

Nomination of candidates

(1) A person shall be nominated by as a candidate the delivery of a nomination
paper signed by him and subscribed in accordance with any regulations made
under the Electoral Provisions Ordinance ( Cap. 367)- (L.N. 221 of 1995)

   (a)  to the returning officer;

   (b)  within the nomination period;

   (c)  at the specified address; and

   (d)  by the candidate in person or in such other manner as authorized by
        the Chief Electoral Officer.

(2) The nomination paper shall-

   (a)  state the identity card number, name and residential address of the
        person being nominated as a candidate;

   (b)  state the identity card number, name and residential address of each
        of its subscribers;

   (c)  contain a declaration by the person referred to in paragraph

   (a)  to the effect that he is qualified for nomination as a candidate, that
        he is not disqualified from being so nominated and that he consents to
        his nomination as such; and

   (d)  contain such other particulars or information (if any) required to be
        furnished in the specified form. (L.N. 221 of 1995)

(3) The nomination paper shall be signed by each subscriber.

(4) The returning officer may, as regards any nomination, require a person in
respect of whom a nomination paper has been submitted to furnish such other
information as he considers appropriate to satisfy himself as to whether that
person is qualified to be nominated or as to the validity of the nomination,
in addition to the particulars and information required to be furnished under
subsection (2). (L.N. 221 of 1995)

(5) Subject to subsection (2), a nomination paper shall be in the specified
form.

(6) Only one person can be nominated as a candidate by one nomination paper.

(7) The particulars or information referred to in subsection (2)(d) may differ
having regard to the election to which the nomination relates.

(8) Without prejudice to section 9 or the effect of non-compliance with any
requirement imposed in relation to a nomination by any regulations made under
the Electoral Provisions Ordinance ( Cap. 367), a nomination paper which does
not comply with any requirement specified in or made under this section shall
be invalid. (Enacted 1994)
