Sealing of ballot papers in packets

PART V DISPOSAL OF DOCUMENTS

(1) As soon as practicable after the returning officer has ascertained the
result of the poll in an election, he shall, at the counting station, make up
into separate sealed packets-

   (a)  the counted ballot papers;

   (aa) the unissued ballot papers; (L.N. 221 of 1995)

   (b)  the unused ballot papers;

   (c)  the spoilt ballot papers; and

   (d)  the rejected ballot papers.

(2) The returning officer shall endorse each such sealed packet with a
description of its contents, the date of the election to which they relate and
the name of the constituency concerned.

(3) Any candidate in respect of the constituency concerned or an election
agent or counting agent of such a candidate may be present when the returning
officer makes up the sealed packets and endorses them.

(4) The returning officer shall, before he makes up the sealed packets,
inform-

   (a)  the candidates who are present at the counting station; and

   (b)  either the election agent or counting agent of any candidate who is
        not present at the counting station, if either such agent is present,
        that they may be present when he makes up the sealed packets and
        endorses them. (Enacted 1994)
