BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 4

Notice of by-election where office of member declared vacant

(1) Not later than 14 days beginning on the date a notice under section 5G of
the Electoral Provisions Ordinance ( Cap. 367) is published as regards a
constituency, the Chief Electoral Officer shall, subject to section 5H(2) of
that Ordinance, publish in the Gazette a notice which shall contain, as
regards the relevant constituency, the particulars required to be contained,
stated or specified in a notice published under section 3(1).

(2) Where a notification of a vacancy in the office of a member is published
under-

   (a)  section 18 of the Urban Council Ordinance ( Cap. 101);

   (b)  section 20 of the Regional Council Ordinance ( Cap. 385); or

   (c)  section 14 of the District Boards Ordinance ( Cap. 366), the Chief
        Electoral Officer shall, subject to section 24(2) of the
        Electoral Provisions Ordinance ( Cap. 367), and not later than 14 days
        beginning on the date of such publication, publish in the Gazette a
        notice which shall contain, as regards the relevant constituency, the
        particulars required to be contained, stated or specified in a notice
        published under section 3(1).

(3) Section 3(3) and (4) shall apply in relation to a notice under this
section subject to necessary modifications. (Enacted 1994)
