BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 38

Spoilt ballot papers

Caution: This is a past version. See the current version here.

Where an elector-

   (a) inadvertently deals with his ballot paper in such a manner that it
cannot be properly used as a ballot paper; or

   (b) makes an error in marking his ballot paper, and gives the ballot paper
to the presiding officer and establishes inadvertence or the fact that
he has made an error, as the case may be, to the satisfaction of
the presiding officer, the presiding officer may give him another
ballot paper relating to the constituency concerned, in place
of the ballot paper so given (in this Regulation referred to as a "spoilt
ballot paper" ( )) and the presiding officer shall forthwith

cancel the spoilt ballot paper by endorsing on the front the word "SPOILT"
and " ".
