BOUNDARY AND ELECTION COMMISSION (ELECTORAL PROCEDURE) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 33

Challenge of electors

(1) If at the time a person applies for a ballot paper or after he has applied
for a ballot paper and before he has left the polling station, a candidate,
his election agent or polling agent declares to the presiding  officer that he
has reasonable cause to believe that the applicant has committed the offence
of personation, as defined by section 6 of the
Corrupt and Illegal Practices Ordinance ( Cap. 288), and undertakes to
substantiate the charge in a court, or if the presiding officer has reason to
believe that the applicant has committed that offence, the presiding  officer
may request a police officer to arrest the applicant.

(2) A person in respect of whom a declaration is made under subsection (1)
(whether or not such person has been arrested under that subsection) or a
person who has been so arrested pursuant to the presiding  officer having
reason to believe that he has committed the offence of personation, shall not
by reason thereof only be prevented from voting. (Enacted 1994)
