BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 5

Extract of final register

(1) Where-

   (a)  after an order is made under section 3(1)(a) or (b) respectively of
        the Electoral Provisions Ordinance ( Cap. 367) declaring
        constituencies in respect of an ordinary election as regards the Urban
        Council or the Regional Council; and

   (b)  after a final register is compiled and published for a particular year
        having regard to the constituencies declared by that order, a
        by-election is to be held to fill a vacancy in the membership of the
        Urban Council or the Regional Council, in respect of a constituency
        declared under the appropriate section referred to in paragraph (a) in
        respect of the immediately preceding ordinary election, the
        registration officer shall, subject to subsection (2), as soon as
        practicable, issue an extract of the final register referred to in
        paragraph (b) showing the identity card number, name and the
        particulars referred to in section  4 (1)(b)(ii) of each person
        entitled to vote in respect of the constituency as regards which the
        by-election is to be held.

(2) Where the constituency in respect of which such by-election is to be held
is identical (as regards area, boundaries and name) to a constituency declared
in the order referred to in subsection (1)(a), the requirement in subsection
(1) to issue an extract shall not apply in relation to the constituency first
mentioned.

(3) Upon the issue of an extract under subsection (1), the registration
officer shall publish in the Gazette and in at least 1 English language daily
newspaper and 1 Chinese language daily newspaper, each in circulation in Hong
Kong, a notice or where appropriate more than 1 notice, that a copy of the
extract is available for inspection by the public during office hours on any
working day and specify in the relevant notice an address or addresses at
which the extract may be so inspected. (Enacted 1994)
