(b) An entry in a register relating to an elector in respect of a constituency shall- (i) show the identity card number and name of that elector; and (ii) contain- (A) the letter "M" for male or "F" for female to denote the sex of that elector; and (B) the address of the principal place of residence of that elector. (L.N. 586 of 1994) (2) The order in which the names of electors are to be arranged under subsection (1)(b)(i) shall be determined by reference to the alphabetical and numerical order of their identity card numbers. (3) In the register, the name of an elector shall be entered in- (a) English, if the signature of the applicant on the relevant application is in English; (b) Chinese, if such signature is in Chinese; and (c) English or Chinese, as determined by the registration officer, if the application was signed otherwise than in the manner referred to in paragraph (a) or (b). (4) Subject to this section, the register shall be in such form as the registration officer considers appropriate. (4A) Without affecting the generality of subsection (4), the registration officer may, in such manner as he thinks fit, indicate in a register, in relation to a person whose name or identity card appears in it- (a) whether he is registered to vote in respect of a functional constituency and, if he is, the relevant functional constituency; and (b) whether he is registered to vote in respect of the election committee constituency. (L.N. 586 of 1994) (4B) In subsection (4A), "election committee constituency" (選舉委員會組別) and "functional constituency" (功能組別) have the meanings assigned to them by the Legislative Council (Electoral Provisions) Ordinance (Cap. 381). (L.N. 586 of 1994) (Enacted 1994) "election committee constituency" (選舉委員會組別) and "functional constituency" (功能組別) BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 5 (Not adopted as the Laws of the HKSAR) VerDate:01/07/1997 BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 5 Extract of final register VerDate:30/06/1997 (1) Where- (a) after an order is made under section 3(1)(a) or (b) respectively of the Electoral Provisions Ordinance (Cap. 367) declaring constituencies in respect of an ordinary election as regards the Urban Council or the Regional Council; and (b) after a final register is compiled and published for a particular year having regard to the constituencies declared by that order, a by-election is to be held to fill a vacancy in the membership of the Urban Council or the Regional Council, in respect of a constituency declared under the appropriate section referred to in paragraph (a) in respect of the immediately preceding ordinary election, the registration officer shall, subject to subsection (2), as soon as practicable, issue an extract of the final register referred to in paragraph (b) showing the identity card number, name and the particulars referred to in section 4(1)(b)(ii) of each person entitled to vote in respect of the constituency as regards which the by-election is to be held. (2) Where the constituency in respect of which such by-election is to be held is identical (as regards area, boundaries and name) to a constituency declared in the order referred to in subsection (1)(a), the requirement in subsection (1) to issue an extract shall not apply in relation to the constituency first mentioned. (3) Upon the issue of an extract under subsection (1), the registration officer shall publish in the Gazette and in at least 1 English language daily newspaper and 1 Chinese language daily newspaper, each in circulation in Hong Kong, a notice or where appropriate more than 1 notice, that a copy of the extract is available for inspection by the public during office hours on any working day and specify in the relevant notice an address or addresses at which the extract may be so inspected. (L.N. 586 of 1994) (2) An application under this section shall be in the specified form and signed by the applicant and may be completed either in English or Chinese and sent by post or delivered by hand to the registration officer. (3) An application for registration in a provisional register compiled for a particular year must be made so as to be received by the registration officer on or before 1 June in that year. (L.N. 586 of 1994) (4) An application for registration in a provisional register received after 1 June in any year shall be treated as an application received on or before 1 June in the next following year for registration in the provisional register compiled for that following year. (L.N. 586 of 1994) (Enacted 1994) BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 7 (Not adopted as the Laws of the HKSAR) VerDate:01/07/1997 BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 7 Powers and procedure on application for registration in provisional register VerDate:30/06/1997 (1) Where the registration officer receives an application for registration under section 6, he shall as soon as practicable, subject to subsections (2), (3) and (4), determine- (a) that the applicant is entitled to be registered; or (b) that the applicant is not entitled to be registered. (L.N. 586 of 1994) (2) Subject to subsection (4), before making a determination under subsection (1), the registration officer- (a) may request the applicant in writing to furnish- (i) either further particulars relating to the application or proof that he is entitled to be registered in the provisional register; or (ii) both such particulars and proof; and (b) shall, where he makes such a request, inform the applicant in writing that the registration officer may decide to take no further action as regards the application if the particulars are, or the proof is, not received by the registration officer within a period specified by him or on or before 10 June next following the making of the request, whichever is earlier. (L.N. 586 of 1994) (3) Where an applicant does not furnish particulars or proof to the satisfaction of the registration officer to be received by him within the period specified under subsection (2)(b) or on or before the date referred to in that subsection, as the case may be, the registration officer may decide to take no further action as regards the relevant application, and where the applicant does so furnish the particulars or proof, or both (where applicable), the registration officer shall make a determination under subsection (1)(a) or (b). (L.N. 586 of 1994) (4) Where the registration officer is satisfied that any application for registration in the provisional register received by him is manifestly an abuse of the registration procedure, he shall take no further action as regards that application. (L.N. 586 of 1994) (4A) Where the registration officer is satisfied that an applicant for registration in a provisional register is registered in the existing final register, he may take no further action as regards that application. (L.N. 586 of 1994) (5) Where the registration officer determines under subsection (1)(a) that an applicant is entitled to be registered as an elector, he shall, as soon as reasonably practicable- (a) determine, having regard to the address furnished by the applicant as his principal place of residence, the part of the provisional register in which to register him; and (b) register the applicant in that part, and inform the applicant in writing accordingly. (6) Where the registration officer makes a determination under subsection (1)(b) or decides under subsection (3) to take no further action as regards an application he shall, as soon as practicable, inform the applicant concerned in writing of such determination or decision. (Enacted 1994) BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 8 (Not adopted as the Laws of the HKSAR) VerDate:01/07/1997 BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 8 Proposed omission of names from final register VerDate:30/06/1997 (1) The registration officer may, in accordance with subsection (2), make such inquires as he thinks fit for the purpose of ascertaining- (a) whether a person whose name appears in the existing final register- (i) is dead; (ii) has ceased to be ordinarily resident in Hong Kong; (iii) is not entitled to be registered as an elector under section 7(1)(a) of the Electoral Provisions Ordinance (Cap. 367); (iv) fails to satisfy the requirements of section 8, 8A, 9 or 10 of that Ordinance; or (v) is disqualified under section 11 of that Ordinance; or (b) whether the address contained under section 4(1)(b)(ii) in relation to an entry in respect of a person is no longer the address of that person's principal place of residence. (L.N. 365 of 1994) (2) An inquiry under subsection (1)- (a) shall be made in writing and sent by post; and (b) may be made- (i) of a person whose name appears in an existing final register, only on or before 1 June in any year; and (ii) of any other source the registration officer considers appropriate, at any time. (L.N. 586 of 1994) (3) Where an inquiry is made of any public officer pursuant to subsection (2)(b)(ii), the officer shall provide the relevant information within a period which the registration officer considers reasonable in the particular case. (L.N. 586 of 1994) (4) For the avoidance of doubt it is declared that an inquiry under this section shall not be made for any purpose other than that of compiling a register. (L.N. 586 of 1994) (5) Any information obtained under this section shall not be used other than for the purpose of compiling a register or in connection with an investigation or proceedings relating to an offence under this Regulation. (L.N. 586 of 1994) (6) Subject to subsection (8), the registration officer shall include in a provisional register a list consisting of- (a) the identity card number, name and other particulars referred to in section 4 of a person who was the subject of an inquiry under this section in the year for which that provisional register is being compiled, if- (i) the inquiry was made of that person, and- (A) the information sought was not received by the registration officer within 1 month beginning on the date it was made; or (B) that person, in response to the inquiry, informs the registration officer that he does not wish his identity card number, name or other particulars to be included in a register; (ii) it appears to the registration officer, from information received in response to the inquiry or otherwise, that such person is dead or had ceased to be entitled to be registered; (iii) the registration officer, notwithstanding any information to the contrary received by him, is satisfied that such person is dead, disqualified from being registered or not qualified to be registered; (iv) the registration officer has reason to believe, from information received in response to the inquiry or otherwise, that the address contained under section 4(1)(b)(ii) in relation to the entry relating to that person is no longer the address of his principal place of residence, and the address of his principal place of residence is not known to the registration officer at the time the list is prepared; or (v) the registration officer, notwithstanding any information to the contrary received by him, is satisfied that the address contained under section 4(1)(b)(ii) in relation to the entry relating to that person is no longer the address of his principal place of residence, and the address of his principal place of residence is not known to the registration officer at the time the list is prepared; (b) the identity card number, name and other particulars referred to in section 4 of a person whose name appears in the existing final register and of whose death the registration officer has received information from the Registrar of Births and Deaths on or before 1 June of the year for which that provisional register is being compiled and after 1 June of the immediately preceding year. (L.N. 586 of 1994) (7) The registration officer shall show in the provisional register that the identity card numbers, names and other particulars in the list referred to in subsection (6) are those he proposes to omit from the final register to be compiled for that year. (8) The identity card number, name or other particulars of a person referred to in subsection (6)(a)(i)(A) shall not be included in a list of proposed omissions unless the registration officer has sent to him by post, a notice (whether contained in the inquiry or otherwise) at the address shown in the existing final register and any other address the registration officer thinks fit, stating that the registration officer proposes to omit his identity card number, name and other particulars from the final register to be compiled, if the relevant information is not received by him within 1 month beginning on the date of the inquiry. (L.N. 586 of 1994) (Enacted 1994) BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 9 (Not adopted as the Laws of the HKSAR) VerDate:01/07/1997 BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 9 Entry of corrected particulars in provisional register VerDate:30/06/1997 (1) An elector whose identity card number, name or any particular referred to in section 4(1)(b)(ii) appears in the existing final register may request the registration officer in writing to make, in the entry relating to him, such alteration as specified by him. (2) Where the registration officer- (a) receives a request under subsection (1) on or before 1 June in any year and after 5 July of the immediately preceding year; and (L.N. 586 of 1994) (b) is satisfied that the entry relating to the person is incorrect and should be corrected as requested, he shall, when compiling the provisional register for that year, enter in the appropriate place therein the particulars of the elector concerned corrected as requested, but if he is not so satisfied he shall not alter that entry. (3) If as a result of information obtained- (a) pursuant to an inquiry under section 8; or (b) by any other means, on or before 1 June in any year and after 5 July of the immediately preceding year, it appears to the registration officer that in the existing final register any particular in an entry to which the information relates is incorrect, he may, when compiling the provisional register for that year, enter in the appropriate place the corrected particular. (L.N. 586 of 1994) (4) Where, under this section, the registration officer makes a correction or decides not to alter an entry as requested he shall, as soon as practicable, notify the elector concerned by post of such correction or decision, as the case may be. (Enacted 1994) BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 10 (Not adopted as the Laws of the HKSAR) VerDate:01/07/1997 BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 10 Contents of provisional register VerDate:30/06/1997 (1) The provisional register required to be compiled for the purposes of section 14 of the Electoral Provisions Ordinance (Cap. 367) shall consist of the following- (a) subject to subsection (2), sections 8, 9 and 19(3), the particulars referred to in section 4(1)(b) of each person whose identity card number or name appears in the existing final register, not being a person whose particulars are included in a list of proposed omissions; (b) such particulars of each person whose application for registration in that register was received by the registration officer during the period beginning on 2 June in the year immediately preceding the year for which the provisional register is being compiled and ending on 1 June of the year for which it is being compiled, and whom the registration officer has determined, under this Regulation, to be entitled to be registered; (c) such particulars of a person whose claim under section 16 has been allowed by the revising officer during the period beginning on 18 July in the year immediately preceding the year for which the provisional register is being compiled and ending on 1 June of the year for which it is being compiled under the Electoral Provisions Ordinance (Cap. 367) or any subsidiary legislation made thereunder; and (d) the list of proposed omissions. (2) The registration officer shall not include in the provisional register the identity card number, name or any other particular referred to in section 4(1)(b)(ii) of any person in respect of whom an objection made under section 15(1) has during the period beginning on 18 July in the year immediately preceding the year for which the provisional register is being compiled and ending on 1 June next following, been allowed by the revising officer under the Electoral Provisions Ordinance (Cap. 367) or any regulation made thereunder. L.N. 586 of 1994) BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 11 (Not adopted as the Laws of the HKSAR) VerDate:01/07/1997 BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 11 Publication of notice of provisional register and inspection VerDate:30/06/1997 (1) Before 22 June in any year, the registration officer shall complete the compilation of the provisional register and- (a) publish, before that date, in the Gazette and in at least 1 English language daily newspaper and 1 Chinese language daily newspaper, each in circulation in Hong Kong, a notice or where appropriate more than 1 notice, that a copy of the provisional register or a specified part thereof (where applicable) is available for inspection by the public during office hours on any working day during the period referred to in paragraph (b), and specify in the relevant notice an address or addresses at which a copy of the entire provisional register or the relevant part of it, as may be appropriate, may be so inspected; and (b) make available for inspection by the public a copy of the provisional register, as a whole or in parts, during the period commencing on the date of publication of a notice under paragraph (a) and ending on 5 July next following that date, at such address or addresses. (2) The registration officer may, if he considers it appropriate, make available for public inspection a copy of a specific part of the provisional register at an address additional to any address referred to in subsection (1) and at such hours and during such period as he thinks fit. (3) The registration officer may, at any time, arrange the entries in a provisional register or any part of it in such form as he considers appropriate and make available, in accordance with subsection (4), a copy of the provisional register or any extract from it, so arranged, to any person he thinks fit, for any purpose related to an election. (4) Where the registration officer makes available a copy of the provisional register or an extract from it under subsection (3), he shall specify the particular election in relation to which the copy of that register or the extract from it, as may be appropriate, may be used. (5) Where a copy of the provisional register or an extract from it is made available to a person under subsection (3), he shall not, in relation to the copy or extract, do any act specified in section 21(3)(a), (c) or (d), for a purpose other than a purpose related to the particular election specified in relation to that copy or extract, as the case may be, under subsection (4). (L.N. 586 of 1994) (3) Any person (not being a person referred to in subsection (2)) whose particulars appear in any part of the provisional register or final register may make a claim that he is entitled to have such particulars entered in a part of such provisional register or final register, as the case may be, being a part other than that in which they appear. (4) Any person whose request under section 9(1) to alter any particular in an entry relating to him in a register has been refused by the registration officer under section 9(2) may make a claim to have such particular altered as requested by him. (2) Where the registration officer- (a) receives a request under subsection (1) after 1 June in any year and on or before 5 July next following; and (b) is satisfied that the entry relating to that person is incorrect and should be corrected as requested, he shall, when compiling the final register for that year, enter in the appropriate place therein the particulars of the person concerned corrected as requested, but if he is not so satisfied he shall not alter that entry. (3) If as a result of information obtained- (a) pursuant to an inquiry under section 8; or (b) by any other means, on or before 5 July in any year, it appears to the registration officer that any particular in the entry to which the information relates is incorrect, he may, when compiling the final register for that year, enter in the appropriate place the corrected particular. (4) Where the registration officer makes a correction under this section or decides under subsection (2) not to alter an entry, he shall as soon as practicable notify the elector concerned by post of the correction or decision, as the case may be. (5) Where a request by a person for the alteration of the particulars relating to him in a register is received by the registration officer after 5 July in any year he shall not consider it in relation to the final register for that year, but may consider it for the purpose of compiling the provisional register for the following year and where he does so, section 9(2) and (4) shall apply as regards such request as if it were received by the registration officer on or before 1 June in that following year in relation to the existing final register for that following year. (6) Where the registration officer decides not to alter an entry in relation to a request by a person made after 1 June in any year but on or before 5 July next following for alteration of the particulars relating to him in a register, the registration officer shall refer the matter to the revising officer and such reference shall be deemed to be a notice of claim made under section 16 by the person to whom the entry relates. (2) The registration officer shall not correct, make or remove an entry under subsection (1) unless he has- (a) obtained the approval of the revising officer for the proposed correction, addition or removal on or before 17 July in the year for which the final register is being compiled; and (b) thereafter sent a notice by post to the person concerned at his last known address, informing him of the proposed correction, addition or removal, as the case may be. (L.N. 586 of 1994) BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 19 (Not adopted as the Laws of the HKSAR) VerDate:01/07/1997 BOUNDARY AND ELECTION COMMISSION (REGISTRATION OF ELECTORS) (GEOGRAPHICAL CONSTITUENCIES) REGULATION - SECT 19 Contents of final register VerDate:30/06/1997 PART IV FINAL REGISTER (1) The final register required to be compiled for the purposes of section 14 of the Electoral Provisions Ordinance (Cap. 367) shall consist of the following- (a) subject to subsections (2) and (3), the particulars referred to in section 4(1)(b) contained in the provisional register for that year as corrected, where appropriate, under section 18 or 18(A); (b) (Repealed L.N. 586 of 1994) (c) such particulars of each person who has made a claim under section 16 and whom the revising officer has ruled to be entitled to be registered in that final register. (2) The registration officer shall not include in a final register the identity card number, name or any other particular of any person- (a) in respect of whose registration an objection made under section 15 has been allowed by the revising officer; or (b) subject to subsection (3), whose claim under section 16 has not been allowed by the revising officer; or (c) whose identity card number or name is in the list of proposed omissions and who has not made a claim under section 16 or whose claim under that section has not been allowed by the revising officer. (3) Where an objection under section 15 or a claim under section 16 has been made as regards- (a) the registration of a person in a particular part of the register and the revising officer has made a ruling as regards that part, if any, in respect of which such person is entitled to be registered; or (b) the particulars of a person, and the revising officer has made a ruling in respect of those particulars, the registration officer shall ensure, in the case of paragraph (a), that the person is registered in accordance with the ruling and in the case of paragraph (b), that the particulars are corrected or entered in accordance with the ruling. (4) In this section any reference to- (a) a ruling made by the revising officer; or (b) the revising officer allowing or not allowing any objection or claim, shall be construed- (i) in the case of paragraph (a), as a ruling made by the revising officer; and (ii) in the case of paragraph (b), as an objection or claim allowed or not allowed by him, after 1 June and on or before 17 July in the year for which the final register is being compiled under the Electoral Provisions Ordinance (Cap. 367) or any subsidiary legislation made thereunder. (2) The registration officer may, if he considers it appropriate, make available for public inspection a copy of a specific part of the final register at an address additional to any address referred to in subsection (1) and at such hours and during such period as he thinks fit. (L.N. 586 of 1994) (3) Publication of a notice in accordance with subsection (1)(a) shall be deemed to be publication of the final register for the purposes of section 14 of the Electoral Provisions Ordinance (Cap. 367), or where appropriate, publication of that part of the register to which the notice relates. (4) The registration officer may, at any time, arrange the entries in the final register or any part of it in such form as he considers appropriate and make available, in accordance with subsection (5), a copy of the final register or any extract from it, so arranged, to any person he thinks fit, for any purpose related to an election. (L.N. 266 of 1995) (6) Where a copy of the final register or an extract from it is made available to a person under subsection (4), he shall not, in relation to the copy or extract, do any act specified in section 21(3)(a), (c) or (d), for a purpose other than a purpose related to the particular election specified in relation to that copy or extract, as the case may be, under subsection (5). (L.N. 586 of 1994) (2) Any person who directly or indirectly by himself or by any other person on his behalf conspires with, incites, compels, induces, coerces, intimidates or persuades another person to make a false statement in an application, response, reply, request or notice referred to in subsection (1) or to provide information which he knows to be wrong in a material particular in such an application, response, reply, request or notice commits an offence and is liable to a fine at level 2 and to imprisonment for 6 months. (L.N. 586 of 1994) (3) A person who- (a) reproduces or permits another person to reproduce in any form any particular contained in any entry in a register or an extract thereof referred to in section 11(3) or 20(4); or (b) uses or permits another person to use any information relating to a person obtained for the purpose of compiling a register; or (c) uses or permits another person to use any information relating to a person contained in a register or an extract thereof referred to in section 11(3) or 20(4); or (d) imparts to any other person any information referred to in paragraph (b) or (c), for a purpose other than a purpose related to an election commits an offence and is liable to a fine at level 2 and to imprisonment for 6 months. (2) Notwithstanding subsection (1), anything that was done- (a) pursuant to the regulations repealed by that subsection; (b) in relation to the existing final register in force at the commencement of this section; and (c) which was effective immediately before such commencement, shall continue to have effect unless and until a power conferred by this Regulation is exercised in relation thereto.
