MERCHANT SHIPPING (IBC CODE) REGULATIONS - REGULATION 10
Penalties
(1) If in respect of any ship there is a contravention of regulation 3, 5(8),
6 or 9, the owner and the master of the ship each commits an offence and is
liable-
(a) on conviction upon indictment, to a fine of $100000;
(b) on summary conviction, to a fine of $10000. (37 of 1990 s. 12)
(1A) If in respect of any ship there is a contravention of regulation 4(2),
the owner of the ship commits an offence and is liable-
(a) on conviction upon indictment, to a fine of $100000;
(b) on summary conviction, to a fine of $10000. (37 of 1990 s. 12)
(2) It shall be a defence for a person charged with an offence under these
regulations to prove that he took all reasonable steps to ensure that the
regulations were complied with. (Enacted 1987)
