REVIEW BY A TRANSPORT TRIBUNAL
(1) On receipt of an application for a review of the Commissioner's decision
by a Transport Tribunal, the Commissioner shall fix a time and place for the
review and give not less than 14 days' notice in writing thereof, either
personally or by registered post, to the applicant, and shall inform him that
if neither he nor his authorized representative appears at the hearing and no
written representations are received, the application shall be treated as
withdrawn.
(2) A Transport Tribunal may postpone a review if it thinks fit and where a
review is postponed the Commissioner shall cause a notice in writing to be
served, either personally or by registered post, on the applicant specifying
the date to which the review has been postponed, and shall inform him that if
neither he nor his authorized representative appears at the hearing and no
written representations are received, the application shall be treated as
withdrawn.
(3) If-
(a) an applicant or his authorized representative does not appear before
the Transport Tribunal on the date of the review notified to him in a
notice under subregulation (1) or (2); and
(b) an application makes no written representations, his application for a
review shall be deemed to have been withdrawn.
(4) Where an applicant for a review is deemed to have been withdrawn under
subregulation (3), the Commissioner shall give notice thereof in writing,
either personally or by registered post, to the applicant.
