Powers to inspect waste and determine whether charge is payable

The Director may-

   (a)  for the purposes of section 3, carry out an inspection to determine
        whether a load of waste delivered to a designated waste disposal 
        facility is construction waste and whether the requirement in section 
        3 (1)(b) is complied with; and

   (b)  determine whether a prescribed charge is to be imposed in respect of
        any waste accepted for disposal at a prescribed facility.
