Free passage to means of access at coamings

(1) Where works are to be, or are being, carried out in a hold of a vessel,
free passage to the means of access from the deck to the hold shall be left at
the coamings of the vessel.

(2) If there is a contravention of subsection (1), the person in charge of
works commits an offence and is liable on conviction to a fine at level 3.

(3) Where the employer of the person employed to carry out the works is not
the person in charge of works, if there is a contravention of subsection (1),
the employer shall take the measures required by that subsection as soon as
reasonably practicable after the contravention occurs.

(4) An employer who fails to comply with subsection (3) commits an offence and
is liable on conviction to a fine at level 3.
