SHIPPING AND PORT CONTROL (WORKS) REGULATION - SECT 5
Safe means of access to workplaces, etc.
(1) There shall be provided safe means of access to a workplace.
(2) All breaks, dangerous corners and other dangerous parts of a workplace
shall, in so far as reasonably practicable having regard to the works
concerned, be securely fenced, and the fence shall be maintained in good
condition ready for use and in no place be less than 1 m in height.
(3) If there is a contravention of subsection (1) or (2), the person in charge
of works commits an offence and is liable on conviction to a fine at level 3.
(4) Where the employer of the person employed to carry out works in the
workplace is not the person in charge of works, if there is a contravention of
subsection (1) or (2), the employer shall provide safe means of access
required by subsection (1), or take the measures required by subsection (2),
as the case may be, as soon as reasonably practicable after the contravention
occurs.
(5) An employer who fails to comply with subsection (4) commits an offence and
is liable on conviction to a fine at level 3.
