SHIPPING AND PORT CONTROL (WORKS) REGULATION - SECT 47
Fencing of motors, etc.
(1) Any motor, cog-wheel, chain gearing, friction gearing, shafting, live
electric conductor or steam pipe, when used as a component of a lifting
appliance, shall, in so far as reasonably practicable, be securely fenced
without impeding the safe working of the vessel.
(2) If there is a contravention of subsection (1), the owner of the lifting
appliance and the person in charge of works commit an offence and each is
liable on conviction to a fine at level 3.
(3) This section does not apply to any motor, cog-wheel, chain gearing,
friction gearing, shafting, live electric conductor or steam pipe if it can be
shown that by its position and construction, it is equally safe to a person
employed as it would be if securely fenced.
