TRAVEL AGENTS REGULATIONS - REGULATION 5

Copies to be admissible as evidence

(1) A copy of an entry in the register purporting to be certified by or under
the authority of the Registrar obtained under regulation 3 shall be admitted
in evidence in any criminal or civil proceedings on production without further
proof as prima facie evidence of the facts stated therein.

(2) A copy of a list published in the Gazette under regulation 4 shall be
admitted in evidence in any criminal or civil proceedings on production
without further proof as prima facie evidence that each person named in such
list is licensed.

(3) The fact that the name of any person is absent from a list published in
the Gazette under regulation 4 shall be prima facie evidence that such person
was not, at the date of the publication of that list, licensed.

(4) Any notice published in the Gazette purporting to be a notice by the
Registrar under section 30(1) of the Ordinance shall be admitted in evidence
in any criminal or civil proceedings on production without further proof as
prima facie evidence of the facts stated therein.

(5) A certificate purporting to be under the hand of the Registrar and stating
that the name of a person has been entered on or removed from the register or
has not been entered on the register shall be admissible in any proceedings on
its production and without further proof and shall be conclusive evidence of
the facts stated therein. (Enacted 1985)
