LANDS TRIBUNAL RULES - RULE 46

Applications under sections 23(2) and 28(2)

(1) (a) Proceedings under section 23(2) of the Ordinance shall be commenced by
filing with the Registrar-

        (i)    a notice of application substantially in accordance with Form
               11; and

        (ii)   an affidavit or affidavits setting out the grounds upon which
               the application is made.

   (b)  Where any person applies to the Tribunal under section 28(2) of the
        Ordinance the application shall be accompanied by an affidavit or
        affidavits setting out the grounds upon which the application is made.

(2) A copy of the application to the Tribunal and affidavit or affidavits
shall be served on the Secretary at least 21 days before the time fixed for
hearing.

(3) If the Secretary wishes to oppose the application or be heard thereon he
shall at least 7 days before the time fixed for hearing file with the
Registrar and serve on the applicant a notice of opposition stating the
grounds thereof or stating that he wishes to be heard. (Enacted 1994)
