IMMIGRATION REGULATIONS - CHAPTER 115A IMMIGRATION REGULATIONS - LONG TITLE Empowering section VerDate:30/06/1997 (Cap 115, section 59) [1 April 1972] (L.N. 63 of 1972) IMMIGRATION REGULATIONS - REGULATION 1 (Repealed) VerDate:30/06/1997 (Repealed L.N. 137 of 1994) IMMIGRATION REGULATIONS - REGULATION 1A (Repealed 6 of 1999 s. 5) VerDate:12/02/1999 IMMIGRATION REGULATIONS - REGULATION 1A Interpretation VerDate:27/01/1998 In these Regulations, unless the context otherwise requires- "APEC business travel card" (亞太經合組織商務旅遊證) means a document- (a) issued by- (i) the Director of Immigration; or (ii) the person- (A) of a place outside Hong Kong which is- (I) a member of the organization known as the Asia Pacific Economic Co-operation established in 1989; and (II) recognized in writing by the Director of Immigration for the purposes of this definition; and (B) who is, in relation to that place- (I) equivalent to the Director of Immigration; or (II) accepted in writing by the Director of Immigration as the person who may issue the document; and (b) which enables the holder of the document- (i) if the document is issued by the Director of Immigration, to go to the place referred to in paragraph (a)(ii) without a visa; (ii) if the document is issued by the person referred to in paragraph (a)(ii), to come to Hong Kong as a visitor without a visa; "travel pass" (旅遊通行證) means a document- (a) issued by the Director of Immigration to a person (other than a Hong Kong permanent resident) who- (i) is not the holder of an identity card; or (ii) is the holder of an identity card (other than a permanent identity card within the meaning of the Registration of Persons Ordinance (Cap 177)) which belongs to a class of identity cards, if any, specified in writing by the Director of Immigration for the purposes of this definition; and (b) which enables the holder of the document to come to Hong Kong as a visitor without a visa. (L.N. 593 of 1997) IMMIGRATION REGULATIONS - REGULATION 2 Conditions of stay VerDate:30/06/1997 (1) Permission given to a person to land in Hong Kong as a visitor shall be subject to the following conditions of stay- (a) he shall not take any employment, whether paid or unpaid; (b) he shall not establish or join in any business; and (c) he shall not become a student at a school, university or other educational institution. (2) Permission given to a person to land in Hong Kong in transit shall be subject to the condition of stay that he shall not remain in Hong Kong after the departure of the ship on which he arrived in Hong Kong. (3) Permission given to a person to land in Hong Kong as a student shall be subject to the following conditions of stay- (a) that he shall become a student only at a specified school, university or other educational institution and undertake such course of study as may be approved by the Director; and (b) that he shall not- (i) take any employment, whether paid or unpaid; or (ii) establish or join in any business. (4) Permission given to a person to land in Hong Kong for employment shall be subject to the condition of stay that he shall only take such employment or establish or join in such business as may be approved by the Director. (5) Permission given to a person to land in Hong Kong as a contract seaman shall be subject to the condition of stay that he shall not remain in Hong Kong after the departure of a specified ship or later than 14 days after the date of landing, whichever is earlier. IMMIGRATION REGULATIONS - REGULATION 3 Issue of documents VerDate:27/01/1998 The Director, on payment of the prescribed fees, if any, may issue in such form as he may determine, and may renew- (a) an identity book, and a certificate of nationality and a certificate of identity, for a seaman; (b) a certificate of identity; (c) an entry permit and a re-entry permit; (d) a visitor's permit for a resident of Macau; (e) a document of identity; (L.N. 593 of 1997) (f) an APEC business travel card; (L.N. 593 of 1997) (g) a travel pass; and (L.N. 593 of 1997) (h) a Vietnamese refugee card. (L.N. 71 of 1987) IMMIGRATION REGULATIONS - REGULATION 4 Prescribed immigration examination signal VerDate:30/06/1997 The immigration examination signal referred to in section 3(1) of the Ordinance shall be- (a) by day, the letters H.N.N., shown by means of signal flags; and (b) by night, three lights coloured white in a vertical line one over the other, equally spaced at distances of not less than 1 m and visible from any direction at a distance of at least 1 nautical mile. (L.N. 268 of 1977; L.N. 103 of 1980) IMMIGRATION REGULATIONS - REGULATION 5 Prescribed particulars of the crew of a ship VerDate:30/06/1997 A notice required to be furnished by the captain of a ship to an immigration officer or a chief immigration assistant under section 6(1)(a)(i) or section 6(2)(a)(i) of the Ordinance shall contain the following particulars of each member of the crew- (65 of 1989 s. 5) (a) his given names, surname or patronymic, rating, date of birth and nationality; (b) the date on which and place where. he first signed on as such; and (c) the number of his current seaman's book held. IMMIGRATION REGULATIONS - REGULATION 6 Prescribed particulars of passengers on board a ship VerDate:30/06/1997 A notice required to be furnished by the captain of a ship to an immigration officer or a chief immigration assistant under section 6(1)(a)(ii) or section 6(2)(a)(ii) shall contain the following particulars of each passenger- (65 of 1989 s. 5) (a) his given names, surname or patronymic, occupation, date of birth, nationality and permanent address; (b) his port of embarkation and the port of disembarkation; and (c) the number of his passport or other travel document. IMMIGRATION REGULATIONS - REGULATION 7 Prescribed particulars of passengers on board an aircraft VerDate:30/06/1997 A notice required to be furnished by the captain of an aircraft to an immigration officer or a chief immigration assistant under section, 6(3) of the Ordinance shall contain the following particulars of the passengers- (65 of 1989 s. 5) (a) the given names, surname or patronymic and nationality of each passenger; (b) the number of passengers who embarked at the last departure place of the aircraft; (c) the number of passengers who were on the same flight before it landed at the last departure place of the aircraft; (d) the number of passengers disembarking in Hong Kong; and (e) the number of passengers continuing on the same flight from Hong Kong. IMMIGRATION REGULATIONS - REGULATION 7A Prescribed manner for giving notices VerDate:30/06/1997 A notice under section 13A(2) or (4) of the Ordinance required to be given to a Vietnamese refugee under section 13A(5) of the Ordinance may be given- (a) to him personally; or (b) where in the opinion of an immigration officer or a chief immigration assistant it is not practicable to give the notice personally, in the following manner- (65 of 1989 s. 5) (i) in the case of a person who is a member of a family, to the head of the family; (ii) in the case of a person who is a passenger on board, or a member of the crew of, a ship, to the captain of the ship; (iii) in the case of a person who is employed, to his employer; (iv) by publishing the notice in a publication circulated in the refugee centre in which the person normally resides; (v) by posting the notice on a notice board in the refugee centre in which the person normally resides; or (vi) by broadcasting the notice, on not less than 2 different days, over a loudspeaker, or in any other manner, in the refugee centre in which the person normally resides. (L.N. 175 of 1981) IMMIGRATION REGULATIONS - REGULATION 8 Photographs VerDate:30/06/1997 The photograph required by an immigration officer or immigration assistant to be furnished under section 15(1) of the Ordinance shall be not smaller than 50 mm by 40 mm nor larger than 60 mm by 50 mm. Duty of Director of Immigration in respect of notices of appeal The Director of Immigration shall cause every notice of appeal to be delivered to the chief adjudicator, or any adjudicator nominated by the chief adjudicator as soon as is practicable. 2. Expediting appeals The Tribunal shall deal with an appeal as expeditiously as is practicable, and for that purpose may sit at any time. 3. Appeals to be heard by 2 adjudicators (1) Subject to sub-paragraphs (2) and (3), an appeal to the Tribunal shall be heard and determined by 2 adjudicators sitting together. (2) The Tribunal shall allow an appeal if either adjudicator hearing the appeal considers that the appeal should be allowed under section 53D(1) of the Ordinance. (3) The power under section 53C of the Ordinance to dismiss an appeal without a hearing shall be exercised by 2 adjudicators who need not consider the appeal together, but each of whom shall record his decision in writing. 4. Hearings to be in private An appeal shall be heard in private: Provided that the Tribunal may, if it thinks proper, permit any person to be present at the hearing. 5. Tribunal not confined to grounds set out in notice of appeal A Tribunal may consider any matter which appears to it to be relevant to any ground of appeal permitted by the Ordinance notwithstanding the omission of any reference to such matter in the notice of appeal, and may receive and consider any evidence which appears to it to be relevant to the issues before it notwithstanding that the evidence would not be admissible in a court of law. 6. Respondent on an appeal The Director of Immigration shall be the respondent to an appeal and may be represented by an immigration officer. 7. Representation of appellant An appellant may, if the Tribunal thinks fit so to allow, be represented at the hearing by counsel or a solicitor who is authorized by the appellant to appear as his representative, and where the appellant is so represented, the Tribunal may also allow the Director of Immigration to be represented by counsel or a solicitor. 8. Director of Immigration to prepare facts for Tribunal (1) The Director of Immigration shall, as soon as practicable after notice of appeal is given, cause- (a) a written summary of the facts of the case and of the reasons for the removal order to be prepared and to be referred to the Tribunal; and (b) a copy thereof to be given to the appellant and read over to him in a language he understands if he is unable to read it for himself. (2) If shall not be necessary for the Director of Immigration to comply with sub-paragraph (1) if he is of the opinion that it is not practicable to do so having regard to the time available before the hearing of the appeal; but in any such case an oral statement of the facts of the case and of the reasons for the removal order shall be given at the hearing of the appeal. 9. Notice of hearing date and securing attendance of appellant (1) The Tribunal shall, if there is to be a hearing, cause notice in writing to be given as soon as is practicable to the Director of Immigration and to the appellant stating the time and place of the hearing. (2) It shall be the duty of the Director of Immigration to secure, subject to paragraph 11, the attendance at the hearing notified under sub-paragraph (1), of any appellant who is in custody. 10. Witnesses and evidence (1) The Tribunal may, on its own motion, or, if it thinks fit, on the application of an appellant or of the Director of Immigration, by summons require any person to attend as a witness at the hearing of an appeal at such time and place as may be specified in the summons, and at the hearing to answer any questions or produce any documents in his possession, custody or power which relate to any issue in the appeal. (2) (a) Notwithstanding sub-paragraph (1), no person shall be compelled to give any evidence or produce any document which he could not be compelled to give or produce in proceedings in a court of law. (b) Nothing in this sub-paragraph shall entitle any person to refuse to give any evidence or to produce any document on the ground only that such evidence or document would not be admissible in a court of law and that accordingly he could not be compelled to give or produce it. (3) The Tribunal may require any witness to give evidence on oath or affirmation. (L.N. 446 of 1994) (4) For the purpose of this paragraph, the Tribunal and any adjudicator shall have the same powers in relation to witnesses as a magistrate would have under sections 21 and 22 of the Magistrates Ordinance (Cap 227) in proceedings under Part II of that Ordinance, and a summons to a witness shall be in such form as the chief adjudicator may determine. (5) (a) The Tribunal may allow in respect of a witness who attends at the hearing of an appeal to give evidence (including professional or expert evidence) a professional witness allowance, expert witness allowance or loss allowance, as the case may be, not exceeding the professional witness allowance, expert witness allowance or loss allowance that a magistrate may allow under the Criminal Procedure (Witnesses' Allowances) Rules (Cap 221 sub. leg.) in respect of a witness who attends to give evidence in criminal proceedings. (L.N. 254 of 1984) (b) Any sum allowed under sub-sub-paragraph (a) shall cease to be payable unless claimed within 3 months from the date on which it was allowed. 11. Transfer of hearing to other adjudicators (1) Where an appeal has not been disposed of by the adjudicators hearing it, the chief adjudicator shall make arrangements, if he is of the opinion that it is not practicable for the appeal to be determined by those adjudicators, or determined without undue delay by those adjudicators, for the appeal to be dealt with by one of those adjudicators and another adjudicator or 2 other adjudicators; and the appeal may be dealt with accordingly. (2) Where the adjudicators hearing an appeal consider that the appeal should, for any reason, be dealt with by one of them and another adjudicator, or by 2 other adjudicators, they may make arrangements for the appeal to be so dealt with; and the appeal may be dealt with accordingly. 12. Hearings in absence of appellant The Tribunal may hear an appeal in the absence of the appellant- (a) if the appellant refuses or declines to appear when given the opportunity to do so; or (b) if satisfied that- (i) by reason of illness or injury the appellant cannot attend the hearing; or (ii) if the appellant did attend the hearing he would present a threat to the health or safety of other persons at the hearing, and that it would be proper in all the circumstances to proceed in the absence of the appellant. 13. Record of proceedings The Tribunal shall keep a summary or record of proceedings in every appeal which comes before it in such form as the chief adjudicator may determine. Interpretation In this Schedule, unless the context otherwise requires- "notice of appeal" (上訴通知書) means the form specified by the Director under section 2AD(1) or (2) of the Ordinance for the purpose of lodging an appeal under that section. Notice of appeal to Tribunal (1) The Director shall, at the time of informing an applicant of the right of appeal to the Tribunal under section 2AB(6)(b)(iii) or 2AC(6)(b)(iii) of the Ordinance, provide him with a notice of appeal. (2) An applicant who wishes to appeal to the Tribunal shall lodge with the chief adjudicator a notice of appeal stating his grounds of appeal and the facts upon which he relies, and a copy of such documentary evidence (if any) in support of the appeal. 3. Duty of Tribunal in respect of notice of appeal and documentary evidence The Tribunal shall, as soon as practicable, cause a copy of every notice of appeal and a copy of any such documentary evidence (if any) in support of the appeal that it has received from the applicant to be given to the Director. 4. Expediting appeals The Tribunal shall deal with an appeal as expeditiously as is practicable, and for that purpose may sit at any time. 5. Appeals to be heard by 2 adjudicators (1) Subject to subparagraph (2), an appeal to the Tribunal shall be heard and determined by 2 adjudicators sitting together. (2) Where the Tribunal hearing an appeal, after consulting the parties to the appeal, is satisfied that it is desirable for a hearing or part of a hearing to take place in public, it may by order give such direction and directions as to the persons who may be present. 7. Tribunal not confined to grounds set out in notice of appeal The Tribunal may consider any matter which appears to it to be relevant to any ground of appeal permitted by the Ordinance notwithstanding the omission of any reference to such matter in the notice of appeal, and may receive and consider any evidence which appears to it to be relevant to the issues before it notwithstanding that the evidence would not be admissible in a court of law. 8. Director to prepare facts for Tribunal (1) The Director shall, as soon as practicable after having received a copy of any notice of appeal given to him under paragraph 3, cause- (a) a written summary of the facts of the case in relation to the notice of appeal and of the reasons for the decision not to issue a certificate of entitlement or a certified duplicate thereof to be prepared and to be given to the Tribunal; and (b) a copy of that written summary to be given to the appellant. (2) Unless an appeal is to be heard in the absence of the appellant under paragraph 14, it shall not be necessary for the Director to comply with subparagraph (1) if he is of the opinion that it is not practicable to do so having regard to the time available before the hearing of the appeal; but in any such case an oral statement of the facts of the case and of the reasons for the decision not to issue a certificate of entitlement or a certified duplicate thereof shall be given at the hearing of the appeal. 11. Notice of hearing date The Tribunal shall cause notice in writing to be given as soon as is practicable to- (L.N. 4 of 2000) (a) the Director; and (b) the appellant, stating the time and place of the hearing. 12. Witnesses and evidence (1) The Tribunal may, on its own motion, or on the application of the appellant or of the Director, by summons require any person to attend as a witness at the hearing of an appeal at such time and place as may be specified in the summons, and at the hearing to answer any question or produce any document in his possession, custody or power which relate to any issue in the appeal. (2) (a) Notwithstanding subparagraph (1), no person shall be compelled to give any evidence or produce any document which he could not be compelled to give or produce in proceedings in a court of law. (b) Nothing in this subparagraph shall entitle any person to refuse to give any evidence or produce any document on the ground only that such evidence or document would not be admissible in a court of law and that accordingly he could not be compelled to give or produce it. (3) The Tribunal may require any witness to give evidence on oath or affirmation. (4) For the purpose of this paragraph, the Tribunal and any adjudicator shall have the same powers in relation to witnesses as a magistrate would have under sections 21 and 22 of the Magistrates Ordinance (Cap 227) in proceedings under Part II of that Ordinance, and a summons to a witness shall be in such form as the chief adjudicator may determine. (5) (a) The Tribunal may, on the application of a witness who attends at the hearing of an appeal to give evidence (including professional or expert evidence), allow in respect of him a professional witness allowance, expert witness allowance or loss allowance, as the case may be, not exceeding the professional witness allowance, expert witness allowance or loss allowance that a magistrate may allow under the Criminal Procedure (Witnesses' Allowances) Rules (Cap 221 sub. leg.) in respect of a witness who attends to give evidence in criminal proceedings. (b) Any sum allowed under sub-subparagraph (a) shall cease to be payable unless claimed by or on behalf of the witness who made the application to the Tribunal in that behalf within 3 months from the date on which it was allowed. 13. Transfer of hearing to other adjudicators (1) Where an appeal has not been disposed of by the adjudicators hearing it, the chief adjudicator shall make arrangements, if he is of the opinion that it is not practicable for the appeal to be determined by those adjudicators, or determined without undue delay by those adjudicators, for the appeal to be dealt with by one of those adjudicators and another adjudicator or 2 other adjudicators; and the appeal may be dealt with accordingly. (2) Where the adjudicators hearing an appeal consider that the appeal should, for any reason, be dealt with by one of them and another adjudicator, or by 2 other adjudicators, they may make arrangements for the appeal to be so dealt with; and the appeal may be dealt with accordingly. 14. Hearings in absence of appellant (1) The Tribunal may hear an appeal in the absence of the appellant- (a) if the appellant refuses or declines to appear when given the opportunity to do so; (b) if the appellant fails to appear and the Tribunal is satisfied that he will not appear; or (c) if the Tribunal is satisfied that- (i) by reason of illness or injury the appellant cannot attend the hearing; or (ii) if the appellant did attend the hearing he would present a threat to the health or safety of other persons at the hearing, and having made due enquiry as is practicable, the Tribunal is satisfied that it would be proper in all the circumstances to proceed in the absence of the appellant. (L.N. 4 of 2000) (2) The Tribunal may, if it hears an appeal in the absence of an appellant under subparagraph (1), determine the appeal without an oral hearing on the basis of such written submissions which may have been submitted (if any) to the Tribunal. (3) Nothing in this paragraph shall be taken to prevent the appellant from being represented at the hearing by any person by whom he is able to be so represented under paragraph 9. 15. Record of proceedings The Tribunal shall keep a summary or record of proceedings in every appeal which comes before it in such form as the chief adjudicator may determine. Interpretation In this Schedule, unless the context otherwise requires- "appellant" (上訴人) includes a person who has made an application on behalf of another person under section 2AB(2)(b) or 2AC(2)(b) of the Ordinance; "notice of appeal" (上訴通知書) means the form specified by the Director under section 2AD(1) or (2) of the Ordinance for the purpose of lodging an appeal under that section. 2. Notice of appeal to Tribunal (1) The Director shall, at the time of informing an applicant of the right of appeal to the Tribunal under section 2AB(6)(b)(iii) or 2AC(6)(b)(iii) of the Ordinance, provide him with a notice of appeal. (2) An applicant who wishes to appeal to the Tribunal shall lodge with the chief adjudicator a notice of appeal stating his grounds of appeal and the facts upon which he relies, and a copy of such documentary evidence (if any) in support of the appeal. 3. Duty of Tribunal in respect of notice of appeal and documentary evidence The Tribunal shall, as soon as practicable, cause a copy of every notice of appeal and a copy of any such documentary evidence (if any) in support of the appeal that it has received from the applicant to be given to the Director. 4. Expediting appeals The Tribunal shall deal with an appeal as expeditiously as is practicable, and for that purpose may sit at any time. 5. Appeals to be heard by 2 adjudicators (1) Subject to subparagraph (2), an appeal to the Tribunal shall be heard and determined by 2 adjudicators sitting together. (2) The Tribunal shall allow an appeal if either adjudicator hearing the appeal considers that the appeal should be allowed under section 2AD(5)(a) or (6)(a) of the Ordinance. 6. Hearings to be in private except in special circumstances (1) Subject to subparagraph (2), an appeal shall be heard in private. (2) Where the Tribunal hearing an appeal, after consulting the parties to the appeal, is satisfied that it is desirable for a hearing or part of a hearing to take place in public, it may by order give such direction and directions as to the persons who may be present. 7. Tribunal not confined to grounds set out in notice of appeal The Tribunal may consider any matter which appears to it to be relevant to any ground of appeal permitted by the Ordinance notwithstanding the omission of any reference to such matter in the notice of appeal, and may receive and consider any evidence which appears to it to be relevant to the issues before it notwithstanding that the evidence would not be admissible in a court of law. 8. Respondent on an appeal The Director shall be the respondent to an appeal and may be represented by an immigration officer. 9. Representation of appellant (1) An appellant may be represented at the hearing- (a) by counsel or a solicitor who is authorized by the appellant to appear as his representative; or (b) by such other representative authorized by the appellant as may be approved by the Tribunal. (2) Where the appellant is represented by counsel or a solicitor, the Director may also be represented by counsel or a solicitor. 10. Director to prepare facts for Tribunal (1) The Director shall, as soon as practicable after having received a copy of any notice of appeal given to him under paragraph 3, cause- (a) a written summary of the facts of the case in relation to the notice of appeal and of the reasons for the decision not to issue a certificate of entitlement or a certified duplicate thereof to be prepared and to be given to the Tribunal; and (b) a copy of that written summary to be given to the appellant. (2) Unless an appeal is to be heard in the absence of the appellant under paragraph 14, it shall not be necessary for the Director to comply with subparagraph (1) if he is of the opinion that it is not practicable to do so having regard to the time available before the hearing of the appeal; but in any such case an oral statement of the facts of the case and of the reasons for the decision not to issue a certificate of entitlement or a certified duplicate thereof shall be given at the hearing of the appeal. 11.
