(1)	Any person who possesses or uses any apparatus for 
radiocommunications as a  customer of the holder of a public 
radiocommunications service licence granted under the Telecommunications 
Regulations (Cap 106 sub. leg.) to avail himself of the service provided 
by the holder is, for so long as he is a customer, exempted from the 
obligation to hold a licence under section 8(1) of the Ordinance. 

(2)	Nothing in paragraph (1) exempts any person from the obligation 
to hold a licence under section 8(1) of the Ordinance where the apparatus 
for radiocommunications is used by him for the purpose of providing a 
service to the public by any means of radiocommunications.
