LANDLORD AND TENANT (CONSOLIDATION) ORDINANCE - SECT 10H

Effective date for increases

(1) No increase in rent of any premises pursuant to-

   (a)  a notice under section 10(1A)(a);

   (b)  a certificate under section 10E or 10F; or

   (c)  an order of the Tribunal under section 32(aa), shall take effect
        within a period of 1 year from the date on which the rent of the
        premises was last increased, whether by agreement or otherwise.

(2) For the purposes of this section rent shall, until the contrary is proved,
be deemed to have been increased if the tenant has made any payments, other
than rates, to the landlord, and such additional payments have been made as a
condition of the right to occupation of the premises.

(3) Any increase in rent under section 10(2), (3) or (3AC), 10AA, 10B or 10C
shall not be an increase in rent for the purposes of this section. (Added 53
