CONSTRUCTION INDUSTRY COUNCIL ORDINANCE - SECT 83

Transitional provisions in relation to certain construction operations

(1) This Ordinance does not apply to the following construction operations—

   (a)  construction operations the tender for which had been submitted to the
        employer before the commencement day;

   (b)  other construction operations carried out under a construction
        contract, if the contract had been entered into before the
        commencement day or the construction operations had commenced before
        the commencement day; and

   (c)  construction operations other than those referred to in paragraphs (a)
        and (b), that had commenced before the commencement day.

(2) Despite the commencement of section 71, the repealed Ordinance as it was
in force immediately before the commencement continues to apply to the
construction operations referred to in subsection (1), subject to subsection
(3).

(3) In respect of those construction operations, the powers conferred and the
functions imposed on the CITA under the repealed Ordinance shall be exercised
and performed by the Council.

(4) In this section— “commencement day” (生效日期) means the day on
which this Part comes into operation; “repealed Ordinance”
(被廢除條例) means the Industrial Training (Construction 
Industry) Ordinance ( Cap 317). “commencement day” (生效日期)
“repealed Ordinance” (被廢除條例)
