PROTECTION OF ENDANGERED SPECIES OF ANIMALS AND PLANTS ORDINANCE - SECT 11

Restriction on import of specimens of Appendix II species and Appendix III species

PART 3

REGULATION OF APPENDIX II SPECIES AND APPENDIX III SPECIES

(1) Subject to section 47, a person shall not import a specimen of an
Appendix II species or Appendix III species—

   (a)  except as provided in section 17, 18, 19 or 22; or

   (b)  except under and in accordance with—

        (i)    a licence issued in respect of that specimen under section  23
               (1)(a) prior to the import; and

        (ii)   a Convention certifying document or certificate in lieu issued
               in respect of that specimen.

(2) A person who imports a specimen of an Appendix II species or
Appendix III species under and in accordance with the documents referred to in
subsection (1)(b)(i) and (ii) shall, upon the landing of that specimen in Hong
Kong—

   (a)  produce, or cause to be produced, the relevant licence to an
        authorized officer; and

   (b)  surrender, or cause to be surrendered, the relevant Convention 
        certifying document or certificate in lieu to the authorized officer
        for retention and cancellation.

(3) A person who contravenes subsection (1) or (2) commits an offence and is
liable on conviction to a fine at level 5 and to imprisonment for 6 months.
