LAND TITLES ORDINANCE - SECT 11
Immunity
not yet in operation
(1) No person to whom this subsection applies, acting in good faith, shall be
personally liable in damages for any act done or default made in the
performance or purported performance of any function, or the exercise or
purported exercise of any power, under this Ordinance.
(2) The Government shall not be liable in damages for either—
(a) any act or default referred to in subsection (1); or
(b) any other act done or default made—
(i) by a person, to whom that subsection applies, not acting in
good faith; and
(ii) in the performance or purported performance of any function, or
the exercise or purported exercise of any power, under this
Ordinance, unless that act or default gives rise to an
indemnity under Part 12 and, in any such case, the liability
shall not exceed the amount of the indemnity provided under
that Part in respect of that act or default.
(3) The persons to whom subsection (1) applies are—
(a) the Registrar (including a delegate of the Registrar under
section 10); and
(b) any public officer assisting the Registrar (or any such delegate) in
the performance or purported performance of any function, or the
exercise or purported exercise of any power, under this Ordinance.
